Wireless Providers Counter East Texas Complaints There—and in North Texas

AT&T (AT&T Mobility) (3:22-cv-00293), T-Mobile (Sprint) (3:22-cv-00295, 3:22-cv-00294), and Verizon (Verizon Wireless) (3:22-cv-00291) have responded to a set of Eastern District of Texas complaints that Telecom Network Solutions LLC (TNS) filed in November of last year by suing in separate complaints of their own, each seeking a declaratory judgment of noninfringement—but from the Northern District of Texas instead. The DJ plaintiffs argue that TNS did not take ownership of the patent that it attempted to assert in those November 2021 complaints until December 2021.

Telecom Network Solutions LLC (TNS) has filed a set of Eastern District of Texas complaints, one against each of AT&T (AT&T Mobility) (2:21-cv-00415), T-Mobile (Sprint) (2:21-cv-00418), and Verizon (Verizon Wireless) (2:21-cv-00416). The NPE targets the use of network management techniques, like prioritization, throttling, or data caps based on cellular network congestion and the user’s service plan level, within each defendant’s wireless network. TNS asserts a single patent generally related to “dynamic allocation of network resources” on a per-device basis based on network utilization, implemented through a “bit-rate cap” or “data volume cap”.
