Apex Beam Brings Those Newly Acquired Patents to Bear

Its prior case against Samsung stayed in light of a set of inter partes reviews (IPRs) of the five former Shanghai Langbo Communication Technology patents-in-suit, Apex Beam Technologies LLC has filed a second complaint against Samsung asserting a dozen patents from a different source against the provision of a long list of “5G mobile handsets, tablets, and notebooks”. In a parallel action against TCL (TCT Mobile), not stayed in light of those IPRs, Apex Beam has moved to amend the complaint to add five of those newly sourced patents. TCT Mobile has opposed that motion, through a sur-reply filed with Eastern District of Texas Chief Judge Rodney Gilstrap at the end of February.

Recently recorded patent assignments made public by the USPTO contain noteworthy transfers to multiple plaintiffs now in litigation, including a new source of patents for Apex Beam Technologies LLC, a new source of patents for Pantech Corporation, and a familiar source of patent rights for Crystal Leap Zrt, this time assigning patents directly, though. In Funded 5G Campaign, Apex Beam Acquires Portfolio from New Source, Moves to Amend

In late 2021 and early 2022, Apex Beam Technologies LLC launched litigation, with the backing of a third-party litigation funder, first against TCL (TCT Mobile) and then OnePlus and ZTE, adding a case against Samsung in June 2022. Apex Beam asserted five patents received from Shanghai Langbo Communication Technology in October 2021, but instituted trials in response to petitions for inter partes review (IPR) of all five of those patents have halted litigation, at least against Samsung. Now, Apex Beam has acquired roughly 20 more US patent assets, from a new source, and has moved to amend its complaint against TCL to assert five of them.

Apex Beam Sues Samsung in 5G Campaign

Apex Beam Technologies LLC has added an Eastern District of Texas suit against Samsung (2:22-cv-00188) to its sole litigation campaign. That campaign began—with the apparent backing of a litigation funder—last year with a November case against TCL (TCT Mobile) and expanded earlier this year with February suits against OnePlus and ZTE. Five wireless communications patents are asserted against each defendant, with infringement allegations targeting the provision of 5G mobile phones and/or tablets.

New Texas NPE with Third-Party Funding Receives Operating Company Portfolio

RPX has flagged a recent assignment of dozens of operating company patents to an NPE formed in Texas earlier this year. The new patent holder shares management with a plaintiff that began litigating in late 2021, and notably, public records confirm that both NPEs have received funding from a prominent litigation finance firm.

5G Litigation Expands into a Campaign with Suits Against OnePlus and ZTE

Last November, with apparent backing by a litigation funder, Apex Beam Technologies LLC filed its first patent case, suing TCL (TCT Mobile) in the Eastern District of Texas, where the Texas plaintiff has now expanded the litigation into a campaign by adding suits against OnePlus (2:22-cv-00031) and ZTE (2:22-cv-00032). The same five wireless communications patents are asserted against each defendant, with infringement allegations targeting the provision of 5G mobile phones and/or tablets.

Patent Monetization Veterans Form Texas NPE, Launch 5G Litigation Campaign

Apex Beam Technologies LLC has filed its first lawsuit, accusing TCL (TCT Mobile) (2:21-cv-00438) of infringing five wireless communications patents through the provision of certain 5G mobile handsets and tablets. The Texas plaintiff received the patents, together with a handful of additional US patents, as well as multiple international assets, in an assignment dated in October 2021, about a week after Apex Beam was formed, from a Shanghai-based “IP-centric startup company”.
