Sovereign Peak Ventures Hits Zyxel Communications Before Its OnePlus Case Has Ended

Sovereign Peak Ventures, LLC (SPV), a Dominion Harbor Enterprises, LLC plaintiff, has filed suit against Unizyx (Zyxel Communications) (2:24-cv-00840) in the Eastern District of Texas over six wireless communications patents already in suit in this campaign over a large portfolio of former Panasonic assets. SPV targets the provision of wireless networking products here; in the other active suit in this campaign, against OnePlus Technology, SPV focuses on a subset of wireless charging patents from that same large portfolio.

Litigation over Former Avaya Portfolio Begins
New Patent Litigation
Arlington Technologies LLC, a Dominion Harbor Enterprises, LLC plaintiff, has filed two suits against Comcast (2:24-cv-00768, 2:24-cv-00769) in the Eastern District of Texas. In the first suit, Comcast is accused over the provision of networking products and communications platforms that support features such as Anywhere Calling, BeAnywhere, TWT functionality (as defined in the 802.11ax networking standard), and Wi-Fi Multimedia; in the second, over the use of the Apache Kafka service to “monitor its network infrastructure”. All eight patents-in-suit came to Arlington Technologies from Avaya.

Dominion’s SPV Proceeds in Serial Fashion

In an Eastern District of Texas complaint, Sovereign Peak Ventures, LLC (SPV), a Dominion Harbor Enterprises, LLC plaintiff, has sued OnePlus Technology (2:24-cv-00654) over wireless charging patents from its large portfolio of former Panasonic assets. The new case follows the June 2024 dismissal with prejudice, in light of a settlement, in a Western District of Texas suit that SPV filed in November 2023 against HMD Global, which itself followed the dismissal of a previous case, against HP Enterprise (HPE). SPV has been proceeding in roughly serial fashion—against LG Electronics, TCL, Hisense, Acer, ASUSTek, HP, TP-Link, HPE, and HMD Global—since this litigation campaign began, back in April 2020.

Earlier 2024 Case Bogged Down over Service of Process, Monument Peak Ventures Sues Vivotek

Monument Peak Ventures, LLC (MPV) has filed its second suit of 2024, accusing Vivotek (6:24-cv-00361) of infringing four patents acquired from Eastman Kodak in a new Western District of Texas complaint. The Dominion Harbor Enterprises LLC plaintiff targets facial recognition, object detection, and video summarization features within various image capturing or processing products. The only other active suit in this campaign, filed against TCL (TCT Mobile) in early January 2024, has become mired in a dispute over the proper service of process on foreign defendants, Magistrate Judge J. Baxter Boone recently ordering the defendants to provide an address for certain Chinese entities “to avoid an unnecessary game of ‘whack-a-mole’”.

RPX’s last look at notable patent assignments considered the movement of assets to Ueran Technology LLC from Huawei; to AX Wireless, LLC from SOLiD; to VideoLabs, Inc. from DCX US Agility Platform LLC, a subsidiary of DXC Technology; to Flash Uplink LLC from its publicly traded parent Quest Patent Research Corporation (QPRC); to various entities from Ascend Innovation Management, LLC entities; and to Nera Innovations Limited from multiple entities associated with Atlantic IP Services. It is time for a review of additional notable transfers recorded since then.

Transacted VoIP Portfolio Appears in USPTO Assignment Records
In Case You Missed It
Publicly available USPTO assignment records now reflect the assignment of more than 700 patent assets from an operating company to Arlington Technologies, LLC, a subsidiary of Texas monetization firm Dominion Harbor Enterprises, LLC. The transaction is dated March 29, 2024, with the portfolio described as “valuable technology resources for companies worldwide that want to provide the best possible VOIP service and care to their customers”.

Avaya Divests VoIP Portfolio to Dominion Harbor

Though the deal has yet to be fully reflected in public USPTO assignment records, Dominion Harbor Enterprises, LLC announced on April 3, 2024 that its subsidiary Arlington Technologies, LLC has acquired a “significant portfolio of patents” related to “pioneering voice over internet protocol (VOIP) technology and include more than 675 families, totaling over 1,500 individual patent assets”. The source is Avaya, described in Dominion’s press release as “a global leader in customer experience and communications solutions”. Per David Pridham, Dominion’s chairman and CEO, in that release, “While these patents are no longer core to Avaya’s cloud-based strategy, they will serve as valuable technology resources for companies worldwide that want to provide the best possible VOIP service and care to their customers”.

Dominion Harbor Continues Campaign over Former American Express Patents

Liberty Peak Ventures, LLC (LPV), an entity associated with Texas monetization firm Dominion Harbor Enterprises, LLC, has sued MasterCard (1:24-cv-20455) in the Southern District of Florida over products that “facilitate, maintain, transact, authenticate, validate, authorize, clear, settle, and/or process financial data, financial transactions, mobile payments, contactless payments, and/or online payments using Mastercard Transaction Instruments (e.g., Mastercard Cards) and related access to Mastercard’s payment products, methods, and/or services (e.g., solutions, systems, devices, networks, APIs, software development kits, and/or other product solutions)”. Since launching this litigation campaign in July 2021, the plaintiff has sued nine defendants—including Charles Schwab, Comerica, Fiserv, Regions Financial, Visa, and Zions Bancorporation (Amegy Bank National) and asserted 19 former American Express patents, ten in its latest complaint. At issue are features such as compliance with certain EMV standards, RFID technology, and tokenization.

Dominion’s Monument Peak Ventures Closes Out 2023 with a Pair of New Suits

Last month, Monument Peak Ventures, LLC (MPV) sued Tesla (6:23-cv-00750) over seven patents from a large former Eastman Kodak portfolio, targeting the provision of “image processing and recognition technology” incorporated in its automobiles, including Autopilot, Autosteer, Full Self-Driving, Sentry Mode, and other related features. Now, the Dominion Harbor Enterprises LLC plaintiff has hit Samsara (1:23-cv-05687) over the provision of the Samsara Connected Operations Cloud system, focusing on “Video-Based Safety, Vehicle Telematics, Apps and Driver Workflows, Equipment Monitoring, and Site Visibility” features, which allegedly “integrate[] AI-powered analytics and cloud-based processing, storage, and access to capture and analyze imagery at customer sites and identify important content for review and action”. Three of those former Eastman Kodak patents are now in suit against Samsara.

Dominion’s SPV Sues HMD Global as TP-Link Contests Personal Jurisdiction

Sovereign Peak Ventures, LLC (SPV), a Dominion Harbor Enterprises, LLC plaintiff, has sued HMD Global (6:23-cv-00759) in the Western District of Texas. The only other active case in this campaign is underway there, before District Judge Alan D. Albright; TP-Link has contested personal jurisdiction, prompting SPV to file a notice of intent to conduct venue-related discovery. SPV targets HMD Global over the provision of Nokia-branded smartphones that support Wi-Fi Direct or Qi wireless charging, asserting five from among its large portfolio of former Panasonic assets.
