After a 2022 Dismissal Without Prejudice, SmartWatch Mobileconcepts Refiles Against Philips

In June 2022, SmartWatch Mobileconcepts LLC (SWM) voluntarily dismissed, without prejudice, a Western District of Texas case that it had filed roughly three weeks earlier against Philips (Philips North America) over a single patent generally related to allowing access to a “secured electronic system” after authenticating a user through biometric information obtained from a wearable device. Now, in a new Western District of Texas complaint against the same defendant (6:23-cv-00775), SWM again targets provision of the Lifeline medical alert wearable with that same patent, this time pleading that Philips has had prefiling knowledge of that patent, reaching back to the June 2022 complaint.

Attacked for Failure to Plead Plausible Infringement Claims in Prior West Texas Complaints, NPE Files Another One

Undeterred by challenges to the sufficiency of its pleading in May 2023 complaints filed separately against Alphabet (Google) and Deutsche Telekom (T-Mobile), SmartWatch Mobileconcepts LLC (SWM) has accused Verizon (Verizon Wireless) (6:23-cv-00731) of infringing the same patent by attaching to the new complaint a claim chart with the same level of detail. Both prior defendants accuse SWM of failing to identify several claim elements in its initial infringement allegations, including the recited “secured electronic system” to which the accused smartwatches “achiev[e] secured, short-range RF communication”. In opposition to these motions to dismiss, SWM states plainly that this “secured electronic system” is the smartphone to which the accused watches connect via Bluetooth.

Round Two Filed in Wearables Campaign

SmartWatch Mobileconcepts LLC began its sole litigation campaign last June when it filed separate complaints against Apple, Philips, Qualcomm, and Samsung in the Western District of Texas and against Casio in the Southern District of New York. Throughout, the plaintiff targeted certain authentication features of wearables and/or related software products with a single patent generally related to allowing access to a “secured electronic system” after authenticating a user through biometric information obtained from a wearable device. Those suits have all ended, after little substantive litigation, and SmartWatch has now fired off another round, this one entirely in West Texas, suing Alphabet (Google) (6:23-cv-00398), Deutsche Telekom (T-Mobile) (6:23-cv-00400), Seiko Epson (Epson America) (6:23-cv-00397), and Tanager (Timex) (6:23-cv-00399) over the same patent.

With Several New NPEs Still Waiting in the Wings, DynaIP Opens Up Multiple Campaigns in June

Increasingly prolific monetization firm Dynamic IP Deals, LLC (d/b/a DynaIP) has been busy this month, so far opening up three campaigns—SmartWatch Mobileconcepts LLC focused on smartwatches, HALEY IP LLC on in-vehicle cameras, and WFR IP LLC on wireless earpieces and wearable piece products—and also filing several new cases via controlled plaintiff MISSED CALL LLC. The firm has filed dozens of new cases since the start of this year, and, having formed more than a handful of NPEs in Texas during the first half of 2022, DynaIP shows no signs of slowing down.

Another plaintiff associated with monetization firm Dynamic IP Deals (d/b/a DynaIP) has launched litigation, SmartWatch Mobileconcepts LLC suing Apple (6:22-cv-00570), Casio (1:22-cv-04658), Philips (6:22-cv-00572), Qualcomm (6:22-cv-00569), and Samsung (6:22-cv-00571) over certain authentication features of wearables and/or related software products, including the Apple Watch, Casio G-Shock, Galaxy Watch, Lifeline medical alert wearable, and Snapdragon Wear 1300 wearable software platform, respectively.
