In Return to Litigation, Hyperquery Shifts Focus Away From “Pre-Installed” Google Products

Hyperquery LLC has filed a new round of suits, hitting Amazon (2:24-cv-00617), Nintendo (2:24-cv-00613), and Sony (2:24-cv-00611) in separate Eastern District of Texas complaints, while also suing Roku (6:24-cv-00399) in the Western District of Texas. The last round, a May-to-September affair, targeted ASUSTek, HP, LG Electronics (LGE), OnePlus, Samsung, TCL, and ZTE over the provision of mobile devices equipped with a “pre-installed Google search engine” and/or “pre-installed Google Play Store”. Just one of the two patents previously in suit appears in these latest complaints, with infringement allegations focused on the defendants’ respective app stores.

Hyperquery Adds New Defendants to “Pre-Installed” Google Products Campaign

Following its suit against ASUSTek in early March, Hyperquery LLC has expanded its sole litigation campaign with separate complaints against OnePlus (6:23-cv-00205), TCL (6:23-cv-00206), and ZTE (6:23-cv-00210) in the Western District of Texas. The two asserted patents, developed at DoAT Media Ltd. (a/k/a “Do@” and EverythingMe), are broadly directed to search query technologies. The defendants are accused of infringement through the provision of smartphones that include a “pre-installed Google search engine” and “pre-installed Google Play Store”.

ASUSTek Sued over Former App Launcher’s Patents

ASUSTek (6:23-cv-00178) is the latest defendant to be added to the litigation campaign that Hyperquery LLC—a plaintiff connected with a familiar patent monetization figure—launched in January 2023 with suits against HP, LG Electronics (LGE), and Samsung. In the new Western District of Texas complaint, the plaintiff asserts a single patent generally related to providing an optimized display of information on a device based on a user’s search query. ASUSTek is accused of infringement through the provision of smartphones that support a “pre-installed Google search engine” and “pre-installed Google Play Store”.

Campaign Targeting “Pre-Installed” Google Products Snags LG Electronics as Well

LG Electronics (LGE) (2:23-cv-00007) has been added as a defendant to the recently launched litigation campaign of Hyperquery LLC, which sued HP and Samsung in the Western District of Texas earlier in January. By contrast, the complaint against LGE has been filed in the Eastern District of Texas but still targets the provision of smartphones that incorporate a “pre-installed Google search engine” and “pre-installed Google Play Store” with two patents developed by DoAT Media Ltd. (a/k/a “Do@” and EverythingMe), which offered an app launcher before closing in 2015.

Former App Launcher’s Patents Appear in New West Texas Campaign

Hyperquery LLC has filed its first litigation, suing HP (6:23-cv-00006) and Samsung (6:23-cv-00007) in a pair of Western District of Texas complaints in which infringement of two patents developed by DoAT Media Ltd. (a/k/a “Do@” and EverythingMe) is alleged. Targeted are HP’s Chromebooks and Samsung’s smartphones having “pre-installed Google Play Store that provides different apps such as gaming, movies, TV Shows, etc. to the user”. EverythingMe offered an app launcher, shuttering in 2015; some of the company’s patents moved into Hyperquery’s hands in July 2022. Alphabet (Google) is not named as a defendant in either complaint.

September 2022 Caps Off a Busy Quarter for Patent Transactions—and NPE Litigation

This past quarter, US patents continued to spread among NPEs, including to familiar faces in patent monetization, and while some of those recipients have yet to file any litigation, several did launch new campaigns during Q3, targeting players in the Networking market sector, wireless carriers, e-commerce or software companies, and device makers, among others.
