Rafqa Star Tags Google Again as Federal Circuit Considers Judge Albright’s Treatment of Transfer Evidence

Rafqa Star, LLC has filed a second Western District of Texas suit against Alphabet (Google) (6:23-cv-00716), again targeting the provision of augmented reality (AR) products and related hardware and software with a single patent, related by prosecution to the patent already in suit. Google has asked the Federal Circuit to issue a mandamus order requiring District Judge Alan D. Albright to transfer the first case against it for convenience to the Northern District of California, after Judge Albright threw out, as inconsistent and unreliable, most of Google’s evidence in support of its request to transfer the case.

Patent of Familiar Origin Asserted in New West Texas Case Against Google

Texas plaintiff Rafqa Star, LLC has filed its first litigation, suing Alphabet (Google) (6:22-cv-01207) in a new Western District of Texas complaint. Asserted is a single patent generally related to detecting the movement of a “portable electronic device”, the latest member of a family for which ownership appears to be split. The accused product is the “Google Live View feature within the Android operating system, along with associated hardware and/or software”.
