InnoBrilliance Sues Funai in Campaign over Multiple Video Streams

Following its early July suits against Amazon, Hangzhou Hikvision Digital Technology, Panasonic, Philips, Shenzhen MTC, TCL, Walmart, and Zhejiang Dahua Technology (Lorex Technology), InnoBrilliance, LLC has now added a complaint against Funai Electric (Funai Corp) (1:24-cv-03102) in the Northern District of Georgia. The plaintiff asserts two patents broadly directed to displaying multiple video streams on a “television system”, with Funai accused of infringement through over the support for viewing multiple video streams in the Koninklijke Philips 7900 series QLED TV.

InnoBrilliance Resumes Litigation over Former TP Lab Patent Family

InnoBrilliance, LLC has filed separate Eastern District of Texas lawsuits against Amazon (2:24-cv-00481), Hangzhou Hikvision Digital Technology (2:24-cv-00495), Lorex Holdings (Lorex Technology) (2:24-cv-00485), Panasonic (2:24-cv-00486), Philips (2:24-cv-00483), Shenzhen MTC (2:24-cv-00488), TCL (2:24-cv-00491), Walmart (2:24-cv-00492), and Zhejiang Dahua Technology (2:24-cv-00496) over the support for viewing multiple video streams in their various products, ranging from TVs to videoconferencing solutions. The defendants are accused of infringing two patents, from five asserted across this campaign since its January 2021 start, that generally relate to displaying multiple video streams on a “television system”.

Multiview Video Campaign Pivots Back from TV Makers to Streaming Apps

In January 2021, InnoBrilliance, LLC kicked off its second campaign, suing Sony over the provision of video streaming apps for Playstation and Apple TV devices that allow users to watch multiple channels at once. Subsequent suits focused on makers of smart TVs offering such a “multiview” feature, including those from Samsung, LG Electronics (LGE), and Hisense. However, the plaintiff—an entity linked to AppBrilliance, Inc., and managed by an inventor linked to many other NPEs—has now switched back to streaming apps. In two Southern District of New York complaints, InnoBrilliance accuses FuboTV (1:22-cv-06143) and MLB (1:22-cv-06068) of infringement over multiview-enabled streaming apps as used with Apple TV devices (both defendants) and Hisense smart TVs (FuboTV)—with both apps previously at issue in some of InnoBrilliance’s earlier suits.

Second Plaintiff Managed by AppBrilliance Sues LG Electronics

InnoBrilliance, LLC has sued LG Electronics (LGE) (2:22-cv-00145) in the Eastern District of Texas in a litigation campaign that has previously hit Samsung and Sony, both in the Western District of that state. This time only one of the five prior patents has been asserted, LGE targeted over the provision of certain TVs that support the LG multi-view software system. Such televisions—those displaying multiple streams at once and switching between different content—have been at issue throughout this campaign. The managing member of InnoBrilliance is AppBrilliance, Inc., a Texas entity associated with another plaintiff that just sued LGE, albeit in the Northern District of Texas, Comarco Wireless Systems LLC.

Plaintiff Managed by AppBrilliance’s CEO Expands Both of Its Campaigns—One But Briefly

So far in May, InnoMemory, LLC has added one case to each of its two litigation campaigns. In the first, the Texas plaintiff sued Kyocera (Kyocera Document Solutions America) (3:22-cv-01061) over the provision of certain printers in the Northern District of Texas. In its second, InnoMemory sued KIOXIA (6:22-cv-00479) over the provision of certain solid state drives, this time in West Texas. The two suits share analogous accusations (targeting the inclusion of Nanya Technology memory modules within the accused products), litigation counsel (experienced plaintiff-side firm Ni, Wang & Massand, PLLC), and a disclosure statement indicating that InnoMemory has no “parent corporation” (and that no publicly held corporation owns ten percent or more of its stock). However, such a disclosure does not appear to comply with the local rules of the Northern District of Texas.

Plaintiff Quickly Amends Corporate Disclosure to Comply with Local Rules

On April 20, 2022, Texas plaintiff Comarco Wireless Systems LLC (CWS) filed its second lawsuit, accusing LG Electronics (LGE) infringing three power supply patents. RPX reported on April 25 that the Northern District of Texas complaint was accompanied by a document characterized as a “certificate of interested parties” that provided only the basic filing party disclosure—indicating that CWS has no “parent corporation” and “that no publicly held corporation owns 10% or more of its stock”—rather than containing “a complete list of all [entities] that are financially interested in the outcome of the case”, as local rules require. Two days later, CWS filed an amended version of its prior “certificate”, which identifies four entities so interested in the case, but the document, even as amended (both versions signed by lead counsel Michael C. Smith of Scheef & Stone, LLP), raises additional questions and comparisons.

Comarco Patents at Issue in New USB Charging Campaign

Comarco Wireless Systems LLC (CWS), an NPE associated with AppBrilliance, Inc., has begun litigating the portfolio of nearly 40 patents that it acquired from Comarco, a defunct operating company turned NPE that appears to have ceased operations between late 2012 and early 2013. In June 2019, CWS sued Samsung (2:21-cv-00208) in the Eastern District of Texas. The plaintiff asserts three patents, broadly directed to supplying power to a portable electronic device, with infringement allegations targeting the provision of devices (e.g., Chromebooks, laptops, and power adapters) that are compliant with certain USB Battery Charging specifications.

Assignment Records Released During the Third Week of October Include Multiple Transfers to IPVal Affiliates

RPX noted among the assignment records released during the third week of October patent transfers to two affiliates of IP Valuation Partners LLC (d/b/a IPVal)—one that launched a litigation campaign during the first half of this month, and one that may be poised to take over an IPVal campaign begun earlier this year. Also of note is an assignment to a new NPE managed by Bradley D. Liddle and a security agreement between Brian Yates and an investment manager.

RPX noted, among the USPTO assignment records made available during the second half of September, patent transfers to affiliates of IP Valuation Partners LLC, Monument Patent Holdings, LLC, and IP Bridge, Inc. Other notable transactions involved a new NPE managed by Erich Spangenberg and NPEs with a possible connection to Bradley D. Liddle.
