Three More Defendants Sued over Audio “Hush” Patent

RecepTrexx LLC has asserted its audio level reduction patent in new complaints filed against DEI Holdings (Sound United) (1:24-cv-03200), Magic Leap (1:24-cv-00340), and Sonos (1:24-cv-00339). Targeted is the provision of devices that respond to voice commands to adjust volume. Magic Leap and Sonos have been sued in the District of Delaware, where the cases may be assigned to Chief Judge Colm F. Connolly (who presided over a brief prior case concerning this same patent); Sound United has been hit in the District of New Jersey, starting the 30-day clock to comply with a local rule requiring the disclosure of certain third-party litigation funding.

RecepTrexx Files Barrage of Suits Across Two Separate Campaigns

RecepTrexx LLC has expanded two of its three litigation campaigns, adding suits against Bose (2:24-cv-00060), VIZIO (3:24-cv-00239), and Yamaha (2:24-cv-00061) to its first campaign and cases against 8x8 (1:24-cv-00120), AT&T (2:24-cv-00051), China Huaxin Post and Telecom Technologies (Alcatel Lucent Enterprises USA (d/b/a ALE USA) (1:24-cv-00135), Dialpad (1:24-cv-00136), Ericsson (2:24-cv-00053), GoTo Technologies USA (1:24-cv-10288) Madison Dearborn Partners (Intermedia.net) (1:24-cv-00140), Ooma (1:24-cv-00142), RingCentral (1:24-cv-00144), Ringover (1:24-cv-10271), Talkdesk (1:24-cv-00145), UnitedWeb (Nextiva) (1:24-cv-00143), Verizon (2:24-cv-00057), and Yeastar USA (1:24-cv-00146) to its third. The latter group is accused of infringing a single patent over communications platforms that support features for activating hold music for callers, although the cases against AT&T, Ericsson, and Verizon have already been dismissed (without prejudice). Bose, Vizio, and Yamaha, meanwhile, are accused of infringing a separate patent over devices (soundbars, TVs, and AV receivers, respectively) that support volume adjustment via voice commands issued to a virtual assistant (Amazon Alexa for Bose, Google Assistant for Yamaha, and both for Vizio).

As Signify Exits, RecepTrexx Adds Two More Defendants to Networking Campaign

RecepTrexx LLC initiated its sole litigation campaign in May 2023, having since filed over a dozen cases. Most of those suits have already ended, with litigation remaining live against Aeotec Group, Lumi United Technology, and TP-Link, each sued this past June, and now also against Fortinet (2:23-cv-00519) and Silicon Laboratories (6:23-cv-00772). The defendants are targeted with a single patent over the implementation of the ZigBee 3.0 protocol in various products, including the FortiAP Series Access Point and Silicon Laboratories Wireless Networking Solutions, respectively.

IV Divestiture to Mind Fusion Comes into Sharper Focus

RecepTrexx LLC has been expanding its litigation over six former Intellectual Ventures LLC (IV) patents that the plaintiff received from Mind Fusion LLC in early April. Thus, while it has been clear for some time that at some point earlier this year IV moved a portfolio of patents to Mind Fusion, the size of that divestiture has been a little uncertain. The USPTO recently has made public two assignments from IV affiliates to Mind Fusion, both dated in mid-February, that combined bring the size of the deal into focus.

RecepTrexx Sues Signify over Google Assistant Integration

Signify (Signify North America) (1:23-cv-00777) is the latest defendant to be added to the first litigation campaign of RecepTrexx LLC, launched in May 2023 with a suit against Wink. In the new District of Delaware complaint, the plaintiff asserts a single patent generally related to reducing audio levels to “immediately moderate an intermediate level of prevailing sound volume delivered from an entertainment apparatus”. Signify is accused of infringement through the provision of the Philips 7600 series Borderless design Google TV, with the incorporation of the Google Assistant platform and related voice command functionalities at issue.

RecepTrexx Opens Up Third Litigation Campaign

RecepTrexx LLC has accused ASUSTek (6:23-cv-00485), OnePlus (6:23-cv-00486), and TCL (6:23-cv-00487) of infringing a single reissue patent generally related to a system for delaying the answering of a phone call through the provision of certain call handling features. In early May, the plaintiff started litigating different patents in a campaign targeting the Zigbee 3.0 mesh networking protocol, most recently suing Aeotec, Lumi United Technology (d/b/a Aqara), Philips, and TP-Link, and then later that month sued Xperi (TiVo) over a single patent generally related to a local proxy server. The patents across these three campaigns belong to a portfolio of six former Intellectual Ventures LLC (IV) patents that RecepTrexx received this past April.

Receptrexx Adds Four Defendants to Existing Campaign, Starts a Second One

This past April, Receptrexx LLC received six former Intellectual Ventures LLC (IV) patents from Mind Fusion LLC, the recipient launching litigation over one of them in May. Having sued Extreme Networks, Flex (Wink), Honeywell, HP Enterprise (HPE) (Aruba Networks), Hubitat, Siemens, and TI in separate May complaints, Receptrexx has hit four more defendants in this campaign so far in June, all in the Western District of Texas—Aeotec (6:23-cv-00424), Lumi United Technology (d/b/a Aqara) (6:23-cv-00427), Philips (6:23-cv-00426), and TP-Link (6:23-cv-00428)—and has also begun a second litigation campaign, by suing Xperi (TiVo) (1:23-cv-00586) in the District of Delaware at the end of last month.

Four Quickly Becomes Three
New Patent Litigation
Last week, Receptrexx LLC sued Extreme Networks (6:23-cv-00379), Honeywell (6:23-cv-00380), HP Enterprise (HPE) (Aruba Networks) (6:23-cv-00378), and Siemens (6:23-cv-00382) in separate Western District of Texas complaints targeting the provision of smart home products, including access points, electricity meters, and smart home hubs, that support the ZigBee 3.0 mesh networking protocol, including ZigBee route discovery. The plaintiff asserts the same patent at issue in its trio of earlier complaints, one filed against each of Flex (Wink), Hubitat, and TI elsewhere. Its suit against Aruba Networks lasted roughly one day, a voluntary dismissal without prejudice having already ended that litigation.

New Zigbee Campaign Suggests Another Trickle of IV Divestitures

The latest litigation campaign among a growing number associated with the same patent monetization figure focuses on the support of the ZigBee 3.0 mesh networking protocol, including ZigBee route discovery. Receptrexx LLC has sued Flex (Wink) (1:23-cv-03674), Hubitat (1:23-cv-00502), and TI (2:23-cv-00213) in quick succession in three separate districts: the Southern District of New York, the District of Delaware, and the Eastern District of Texas, respectively. The plaintiff asserts a single patent in each complaint, the patent generally related to IP packet communications between a first LAN radio and a second LAN radio that are not in range of one another but where both determine that they are in range of a third LAN radio through which communications then pass, where that communications route is saved to a database.
