Alice Motion Pending, FrameTech Keeps Filing

Undeterred by an Alice motion pending in the Southern District of Texas, FrameTech LLC has sued Fujitsu (2:25-cv-00058), Hitachi (2:25-cv-00059), and Inspur Group (2:25-cv-00060) in separate Eastern District of Texas complaints, as well as Oracle (7:25-cv-00020), in the Western District of Texas. FrameTech targets products that support remotely “upgrading an operating system on a mainframe computer system”: for Fujitsu, the PRIMERGY server; Hitachi, the Hitachi Advanced Server HA820; Inspur Group, the NF5280M6 servers; and Oracle, the Oracle x86 servers. The pending Alice motion challenges the claims of the sole asserted patent as ineligibly drawn to the abstract idea of “automating the upgrade of an operating system”, with defendant BMC Software drawing the court’s attention to prior sanctioned conduct of FrameTech’s litigation counsel.

Frametech Files Second Complaint Against Broadcom over Software Deployment Tools

Frametech LLC has filed a second suit against Broadcom, this time hitting its subsidiary CA (d/b/a CA Technologies) (2:23-cv-00452) in the Eastern District of Texas. The plaintiff asserts a single patent generally related to remotely “upgrading” an operating system on a “mainframe computer system”, with CA Technologies accused of infringement through the support of software deployment functionalities in its Chorus Software Manager (CSM) platform. Since launching this, its sole litigation campaign, in July 2023, Frametech has sued IBM, KKR & Co. (BMC Software), and OpenText (Micro Focus), in addition to the prior complaint filed against Broadcom itself.

Take Two for System Upgrade Patents

Frametech LLC has filed its first litigation, suing Broadcom (6:23-cv-00495), IBM (2:23-cv-00326), KKR & Co. (BMC Software) (6:23-cv-00494), and Micro Focus (4:23-cv-02572) over the support of software deployment functionalities in their various products: for Broadcom, over its Chorus Software Manager; for IBM, over its z/OS Management Facility system management platform; for BMC Software, over its IPSW Deploy Application Development work environment; and for Micro Focus, over the Enterprise Developer 7.0 for Eclipse integrated development environment (IDE). The patents-in-campaign—generally related to remotely “upgrading” an operating system on a “mainframe computer system”—were asserted briefly by a different plaintiff in separate complaints filed in late 2021 against BMC Software and VMware.
