After Disputed Dismissal, Safety Direct Tags T-Mobile

In a new Western District of Washington complaint, Safety Direct LLC has accused Deutsche Telekom (T-Mobile) (2:23-cv-01930) of infringing the sole patent in its campaign through the provision of the Timex FamilyConnect and Timex FamilyConnect v1 smartwatches, targeting location-tracking features including “SafeZones” where notifications are sent if the wearer leaves a designated area. The patent generally concerns loss prevention software for a mobile device. A hiccup in the dismissal of the last case in the campaign, against Tesla, has prompted Northern District of California Judge Haywood S. Gilliam Jr. to encourage the parties to reach an agreement concerning that dispute, further advising that “[i]f they do not reach an agreement . . . it would consider a motion for attorneys fees and costs by the defendant”. That did the trick—the case was dismissed (again) by stipulation filed on November 28.

Different Plaintiff at the Helm of Campaign Focused on Finding Mobile Devices
New Patent Litigation
New York plaintiff Safety Direct LLC has taken over the campaign that its CEO, Richard Abramson, had been litigating in his individual capacity, last week Safety Direct suing Alphabet (Google) (3:23-cv-03243) in the Northern District of California. The sole asserted patent generally relates to loss prevention software for a mobile device, with the new complaint targeting the provision of various Fitbit, Pixel, and Nexus smartphones and smart watches over their use of the Find My Device app. Recent cases over the same patent, filed separately against Apple and Samsung, have already concluded.
