Clock Ticks for TPLF Disclosure for One Plaintiff as Deadline for Another Has Long Passed

Last week, RPX covered the new campaign launched by New Mexico plaintiff Data Resonance LLC, which hit five defendants in three federal venues, including Informatica in the District of Delaware. That case has since been assigned to Chief Judge Colm F. Connolly, who—pursuant to April 2022 standing orders—requires certain litigants to make detailed corporate and third-party litigation funding disclosures. Data Resonance has promptly filed an amended corporate disclosure, identifying its sole owner and member. Meanwhile, the deadline for an associated entity, Unwired Global Systems LLC, to identify the required third-party litigation funding passed weeks ago. Unwired has made no such disclosure.

New Mexico Plaintiff Launches Data Maintenance Campaign

Data Resonance LLC has launched its first litigation, suing Ataccama (2:23-cv-00625) and IBM (2:23-cv-00626) in the Eastern District of Texas, Cloud Software (TIBCO Software) (1:23-cv-11139) and RELX (d/b/a LexisNexis) (1:23-cv-11136) in the Southern District of New York, and Informatica (1:23-cv-01473) in the District of Delaware. The complaints concern the alleged infringement of a single patent generally related to a system for “indicating direct and indirect relationships among a plurality of data records”, through the provision of certain data maintenance tools in the defendants’ various software products.
