VirtaMove Moves Against Microsoft and Oracle in West Texas, Contests Jurisdiction in Northern California

VirtaMove, Corp. (f/k/a Appzero) has filed separate Western District of Texas complaints against Microsoft (7:24-cv-00338) and Oracle (7:24-cv-00339). Against each defendant in this campaign—including prior defendants Alphabet (Google), Amazon, HP Enterprise (HPE), and IBM—the plaintiff asserts the same two virtual file containerization patents. Infringement allegations against Microsoft focus on the provision of the Azure Kubernetes Service, Azure Arc-enabled Kubernetes, Azure Container Registry, and Azure Container Apps; against Oracle, of the Oracle Cloud Infrastructure and Oracle Kubernetes Engine. VirtaMove has moved to dismiss an August 2024 declaratory judgment complaint filed in the Northern District of California by IBM subsidiary Red Hat.

Not a Matter of “If” . . . But “When”

Red Hat (3:24-cv-04740) has filed a Northern District of California against VirtaMove, Corp. (f/k/a Appzero), seeking declaratory judgments of noninfringement of two virtual file containerization patents that VirtaMove asserted in earlier complaints filed against Red Hat’s parent IBM, as well as against Alphabet (Google), Amazon, HP Enterprise (HPE). Red Hat acknowledges that VirtaMove has yet to name Red Hat’s OpenShift as an accused product but hangs jurisdiction on VirtaMove’s infringement allegations in the prior suits, as “focused on the use and deployment of Kubernetes, Docker, and other open source software programs . . . against the same containerization and container orchestration technologies used in OpenShift”.

VirtaMove Moves Against Three More
New Patent Litigation
VirtaMove, Corp. (f/k/a Appzero) has followed its first suit, against Amazon in the Western District of Texas, with a complaint filed against Alphabet (Google) (7:24-cv-00033) in the same district, as well as separate Eastern District of Texas complaints filed against HP Enterprise (HPE) (2:24-cv-00093) and IBM (2:24-cv-00064). Asserted across these three cases are two patents broadly direct to virtual file containerization. Google has been pegged over the provision of its Google Migrate to Containers service; HPE, over its Ezmeral Runtime Enterprise platform; and IBM, over its Cloud Kubernetes Services platform.

VirtaMove Files Containerization Case Against Amazon

Describing itself as an “innovator and pioneer in containerization” with the mission “to move and modernize the world’s server applications to make organizations more successful and secure”, Canadian plaintiff VirtaMove, Corp. (f/k/a Appzero) has filed suit against Amazon (7:24-cv-00030) in the Western District of Texas, alleging infringement of two virtual containerization patents through the provision of Amazon’s AWS End-of-Support Migration Program and its Amazon’s AWS Elastic Container Service.
