SerComm and Toshiba Sued over Devices Using the WPA2 Security Protocol
New Patent Litigation
SerComm (4:25-cv-00170) and Toshiba (4:25-cv-00171) are the latest defendants to be sued in the sole litigation campaign of Encryptawave Technologies LLC, initiated in March 2024 with a suit against D-Link. In the new Eastern District of Texas complaints, the plaintiff asserts a single patent—previously litigated by IP Edge LLC plaintiff Moxchange LLC—generally related to “providing secure authentication between wireless communication network nodes”. The defendants are accused of infringement through the provision of a wide array of devices, ranging from modems and routers to printers and streaming devices. At issue is the support for “providing secure authentication between wireless communication network nodes” through the WPA2 security protocol.

November Sees Two New Encryptawave Suits, One of Which Has Already Ended
New Patent Litigation
Last month, Encryptawave Technologies LLC added Eastern District of Texas cases against OnePlus (4:24-cv-01057) and Qisda (BenQ) (4:24-cv-01040) to the suits filed in the second half of 2024, those against Konica Minolta, Kyocera, and Vantiva. This campaign focuses on a single patent—generally related to “providing secure authentication between wireless communication network nodes”—that Moxchange LLC had been litigating before Texas monetization firm IP Edge LLC ran into trouble before Delaware Chief Judge Colm F. Connolly. Earlier in 2024, Encryptawave filed separate suits against D-Link, Hitron Technologies, HMD Global, Honeywell, Hon Hai Precision Industry (Sharp), Konica Minolta, and TCL, each of which has followed a pattern: dismissal with prejudice before or after a delay in serving the complaint.

Encryptawave’s WPA2 Security Protocol Campaign Engulfs Four More
New Patent Litigation
This past March, Encryptawave Technologies LLC launched its first litigation by suing D-Link, Hon Hai Precision Industry (Sharp), and TCL in separate Eastern District of Texas cases. Now, the plaintiff has expanded that campaign with three more complaints in the same district, one against each of HMD Global (4:24-cv-00569), Honeywell (4:24-cv-00570), and Konica Minolta (4:24-cv-00588), and another complaint, filed in the District of Colorado, against Hitron Technologies (1:24-cv-01764). The plaintiff targets the support for the WPA2 security protocol within authentication tools in a wide array of devices (e.g., computers, label printers, smartphones, smart microwave ovens, tablets, thermostats, TVs, etc.).

Recent Patent Assignments Foreshadow Litigation from Players Old and New
Patent Market, Patent Watch
Recorded patent assignments recently made public reveal patents on the move, to an NPE that appears to be collecting assets from a familiar source as prior litigated patents run into PTAB trouble; to an entity managed by what appears to be a relatively new monetization operation standing up; to a recent entrant into the litigation funding space; to entities associated with a frequent plaintiff-side law firm in Texas; and to a host of other plaintiffs recently filing suit.
