Sandpiper CDN, LLC has filed an Eastern District of Texas suit against Comcast (2:24-cv-00886) over the provision of its products and services that use “Apache Traffic Control and any of Comcast’s bespoke CDN architecture or solutions”. Asserted are five patents, generally related to various aspects of content delivery networks, that the plaintiff received from Level 3 Communications in a series of 2024 transactions, only one of which is in suit against Alphabet (Google), in a Central District of California suit filed this past May. Google has knocked two of those patents out of the case with an Alice motion.

Earlier this year, on April 24, 2024, 80 issued US patents moved from Level 3 Communications (acquired in 2017 by Lumen Technologies (f/k/a CenturyLink)) to Delaware entity Sandpiper CDN, LLC, in an assignment recorded two days later. On May 31, 2024, another transfer, recorded on June 19, popped up, showing that Sandpiper CDN added three dozen more patent assets to its holdings, from the same source. Assignment records subsequently made public indicate that May 31 was a much busier day in this regard than previously known.

Last month’s review of notable patent assignments considered the movement of assets from Avaya to Dominion Harbor Enterprises, LLC; from Level 3 Communications to Sandpiper CDN, LLC; from Seiko Epson to IPValue’s 138 East LCD Advancements Ltd. and Lumitek Display Technology Ltd.; from Transaction Security to a “BioCrypt Access”; from Fortress Investment Group LLC’s KIP Prod P1 LP to Prodea Automation LLC; from EMM Patents Ltd. to Empire IP LLC; from Siemens and Abdelsalam Helal to Rokiot USA LLC; and from Proxicom Wireless, LLC to Secure Communication Technologies, LLC. While a couple of these entities again feature prominently, this month’s review extends well beyond them to cover the movement of patents away from other operating companies, as well as within several repeat monetization players.

Recently formed Delaware plaintiff Sandpiper CDN, LLC has launched litigation, suing Alphabet (Google) (2:24-cv-03951) in the Central District of California. Six patents, generally related to content delivery networks and received from Level 3 Communications (acquired in 2017 by Lumen Technologies (f/k/a CenturyLink)), are asserted in the new complaint, which targets Google CDN, which the plaintiff contends that Google “uses and sells . . . via its Cloud CDN and Media CDN offerings”, including in connection with YouTube and YouTube TV. Sandpiper CDN pleads that it is “[n]amed after, and in homage to, the company that originally pioneered and developed CDN technologies in the 1990’s”, Sandpiper Networks.

It is time for a review of additional notable transfers recorded since then.
