In New Cases over Emergency Communications Services, e-Beacon Ignores Local Rules

Avaya (3:25-cv-00524) and Match Group (3:25-cv-00523) are the latest defendants to be added to the sole litigation campaign that apparent New Mexico plaintiff e-Beacon LLC initiated in June 2024. In the new complaints, filed in the Northern District of Texas, the plaintiff asserts a single patent generally related to transmitting the location of a “VoIP phone” to an emergency services call center. The defendants are accused of infringement through the provision of their respective mobile apps, which feature the ability to transmit a device’s physical location when triggering emergency services. While local rules in Northern Texas impose heightened disclosure requirements on litigants, e-Beacon—represented by DNL Zito and Rabicoff Law LLC—has ignored those obligations, instead filing bare boilerplate corporate disclosures across both cases.

In Emergency Services Campaign, First Round Done, Second Round Filed

e-Beacon LLC has fired off separate Eastern District of Texas complaints against NEC (2:24-cv-00891), OnePlus (2:24-cv-00889), Progressive Casualty Insurance (2:24-cv-00892), Samsung (2:24-cv-00890), and Sony (2:24-cv-00893). The round comes after the first in this campaign, filed this past June, hit ADT (since dismissed with prejudice after a noticed settlement) in the Eastern District of Texas; Apple (without prejudice) and Uber (also without prejudice), in the Western District of Texas. Each case ended by the middle of September, in the manner parenthetically suggested. The start to this campaign—which concerns a single patent generally related to transmitting the location of a “VoIP phone” to an emergency services call center—suggests it will be conducted in file-and-dismiss fashion.

e-Beacon LLC has filed suit against ADT (2:24-cv-00436) in the Eastern District of Texas and against Apple (6:24-cv-00314) and Uber (6:24-cv-00313) in the Western District of Texas. Asserted is a single patent generally related to transmitting the location of a “VoIP phone” to an emergency services call center, with infringement allegations focused on the support of 911 emergency services in their respective products, including the Apple Watch Series 9, Uber mobile app, and SoSecure by ADT: Safety App, respectively.
