Having recently convinced District Judge Barbara M.G. Lynn in the Northern District of Texas to lift the stay on its prior case against Trend Micro, CUPP Computing AS (as patent owner) and CUPP Cybersecurity LLC (presumably as exclusive licensee) have filed a second one (3:20-cv-03206) in the same district. The stay was imposed to await the outcome of inter partes reviews (IPRs) of seven of the eight patents asserted in the original May 2018 complaint; Judge Lynn lifted the stay, over Trend Micro’s request to leave it in place pending subsequent appeals to the Federal Circuit. CUPP asserts eight more patents in the new case, all generally related to network and device security as well as secure computing.

Norway’s CUPP Computing AS, together with its Delaware subsidiary, CUPP CyberSecurity LLC, have added a second Northern District of Texas case to the litigation campaign begun last month against Trend Micro. The new complaint accuses Symantec (3:18-cv-01554) of infringing the same eight patents, generally related to security mechanisms for mobile networks and devices, through the sale of a long list of anti-malware products, including products characterized as Symantec Endpoint Security products, Network Security products, Endpoint Encryption, and Norton Security products.

Three months after creating wholly owned subsidiary CUPP CyberSecurity LLC, Norwegian entity CUPP Computing AS has filed suit, together with the new Delaware LLC, against Trend Micro (3:18-cv-01251) in the Northern District of Texas. The plaintiffs assert (apparently as patent owner and exclusive licensee) eight patents from CUPP Computing’s portfolio of 24 issued US patents, generally related to security mechanisms for mobile networks and devices. Trend Micro is accused of infringement through the provision of various hardware and software cybersecurity products, including its User Protection, Network Defense, Hybrid Cloud Security, Worry-Free, Home Products, and Trend Micro Portable Security, as well as other products incorporating Trend Micro’s underlying technologies.
