Bluebonnet Adds HP and HPE as Defendants in Web-Based Software Campaign

Following its late July case against Facebook, BCS Software LLC (d/b/a Bluebonnet Consulting Services & Software) has filed suit against HP (6:20-cv-00709) and HPE (6:20-cv-00708) in the Western District of Texas. The NPE asserts in each complaint a three-member family of patents generally related to a system for using a server to monitor certain client applications and distributed components associated with those applications over a network, acquired as part of a larger deal completed with Intellectual Ventures LLC (IV) in August 2018. The defendants are accused of infringement through the provision of web-based software products, with features related to web application management and performance monitoring at issue; for HP, through the provision of HP Device As A Service (DaaS) and HP Print Beat Dashboard; and for HPE, the HPE Intelligent Management Center Enterprise Software Platform.

As Energy Defendants Exit Stage Left, Bluebonnet Consulting Swivels the Litigation Spotlight on Facebook

BCS Software LLC (d/b/a Bluebonnet Consulting Services & Software) has kept active the litigation campaign that it began in April 2019 by filing suit against Facebook (6:20-cv-00695) in the Western District of Texas over the use of the Apache Zookeeper coordination service on its e-commerce website and platform. The plaintiff asserts a single patent, generally related to a system for using a server to monitor certain client applications and distributed components associated with those applications over a network, acquired as part of a larger deal completed with Intellectual Ventures LLC (IV) in August 2018. Each defendant in the last round in this campaign—Honeywell (Elster), Itron, Toshiba (Landis+Gyr Technologies), and Xylem (Sensus)—appears to have settled with Bluebonnet.

The late 2019 peel off by Intellectual Ventures, LLC (IV) of more than 3,500 US assets to a batch of Georgia NPEs has ousted Dominion Harbor Enterprises, LLC from its long-held position as the top NPE assignee of IV divestitures. Meanwhile, as discussed in RPX’s Q1 in Review blog post, throughout the first quarter, NPEs continued filing new litigation asserting patents received from IV, hitting a broad range of targets, including over patents developed by major operating companies.

IoT Campaign, over Patents Picked Up from IV, Engulfs Four More Defendants in West Texas

BCS Software LLC (d/b/a Bluebonnet Consulting Services & Software) (BCS) has sued Honeywell (Elster) (6:20-cv-00002), Itron (6:19-cv-00728), Toshiba (Landis+Gyr Technologies) (6:20-cv-00005), and Xylem (Sensus) (6:20-cv-00003) over a family of three patents that the plaintiff received as part of a larger acquisition from Intellectual Ventures LLC (IV) in September 2018. The patents asserted here generally relate to a system for using a server to monitor certain client applications and distributed components associated with those applications over a network. At issue in these new complaints are the defendants’ Internet-of-Things (IoT) “smart” platforms—Elster’s Connexo platform; Itron’s OpenWay platform; Landis+Gyr’s Gridstream Connect; and Sensus’s FlexNet.

BCS Software Joins the List of Entities to Acquire and Litigate Patents Once Held by IV, Suing LG Electronics and Samsung

Last September, RPX noted the assignment of nearly two dozen US patent assets from an affiliate of Intellectual Ventures LLC (IV) to BCS Software LLC (d/b/a Bluebonnet Consulting Services & Software) (BCS). That entity has now filed its first litigation, suing LG Electronics (LGE) (6:19-cv-00239) and Samsung (6:19-cv-00235) over one of the patents received. That patent generally relates to a system for using a server to monitor certain client applications and distributed components associated with those applications over a network. LGE is accused of infringement through the provision of its Smart ThinQ Hub and supporting software, part of its Smart ThinQ smart home control platform; Samsung, of SyncThru, a printer fleet management system.
