Panasonic Reorg Prompts DJ Action in the Northern District of California

Following an apparent reorganization, Panasonic Entertainment & Communication (PEC), now a subsidiary of Panasonic Holdings, has filed a new complaint asking the Northern District of California for declaratory judgments of noninfringement of four patents generally related to in-camera systems for filtering and correcting distortions. Optimum Imaging Technologies LLC (OIT) asserted the four patents against Panasonic in an October 2023 complaint filed in the Eastern District of Texas and targeting the provision of certain cameras and lenses. PEC pleads that OIT has not yet served Panasonic with the West Texas complaint, although Optimum has apparently “indicated that it will seek to serve Panasonic Corporation through the Hague Convention”.

Optimum Imaging, Backed by Litigation Funding, Takes Aim at Half a Dozen in East Texas

Inventor-controlled Optimum Imaging Technologies LLC has filed six new Eastern District of Texas complaints, accusing Fujifilm (4:23-cv-00922), Nikon (4:23-cv-00923), Olympus and OM Digital Solutions (4:23-cv-00924), Panasonic (4:23-cv-00926), Samsung (4:23-cv-00927), and Sony (4:23-cv-00928) of infringing up to four patents generally related to optical aberration correction. The previous litigation in this campaign, between the plaintiff and Canon, ended in April 2021 after the parties noticed a settlement.

Canon Challenges Enforceability of December 2020 Patents Immediately After Issuance

On December 22, 2020, Canon (1:20-cv-01238) filed suit in the Western District of Texas against Optimum Imaging Technologies LLC, seeking a declaratory judgment of unenforceability of a newly issued patent based on allegations of inequitable conduct before the Patent Office. Canon alleges that the named inventor of the patent improperly represented both that the abandonment of an earlier, related application was unintentional and that the failure to pay related fees was due to “economic constraints”, in response to which the USPTO revived that application. Those representations, according to Canon, render unenforceable the newly issued patent, as well as two others, which Canon addressed in a December 29, 2020 amended complaint in the same case.

Inventor-Controlled Entity Launches Image Correction Campaign

Inventor-controlled Optimum Imaging Technologies LLC has filed suit against Canon (2:19-cv-00246) over the provision of certain cameras and camcorders, including EOS series cameras, PowerShot series cameras, the VIXIA HF G50 camcorder, and the XA20 camcorder. At issue is the “lens aberration correction” feature included in the software of the devices, with two patents—generally related to in-camera systems for filtering and correcting distortions—asserted.
