CommWorks Sues Qualcomm
New Patent Litigation
After suing ASUSTek late last year and both DrayTek and AVM earlier this year, CommWorks Solutions, LLC has filed another complaint, this one against Qualcomm (2:25-cv-00154), all of them in the Eastern District of Texas. This campaign over wireless communications patents, received from Intellectual Ventures LLC (IV), 20 of them to date, asserting in overlapping subsets, began back in May 2020 and has hit more than 30 defendants since. Qualcomm is targeted over the provision of systems-on-chip (SoCs) and/or products (i.e., chipsets and networking platforms) that support IEEE 802.11-2007+, Wi-Fi Multimedia, and Wi-Fi Protected Setup.

Among Latest Cases over Former IV Patents, DataCloud Files a “Notification of Affiliates” That Names No Individual Owners

DataCloud Technologies, LLC, an entity associated with Georgia monetization firm IPInvestments Group LLC, has added to its sole litigation campaign suits against Designer Brands (2:25-cv-00084) in the Eastern District of Texas, Etsy (1:25-cv-00120) in the District of Delaware, and OTTO (Euromarket Designs (d/b/a Crate & Barrel)) (1:25-cv-00847) in the Northern District of Illinois. The three asserted patents, each received from Intellectual Ventures LLC (IV), are broadly directed to either file management or network communications. Northern District of Illinois Local Rules require litigants such as DataCloud to identify “any entity or individual owning, directly or indirectly (through ownership of one or more other entities), 5% or more of a party”; DataCloud’s “Notification of Affiliates”, signed by Rozier Hardt McDonough PLLC, does not appear to comply with the applicable local rule, the notification suggesting that no individual at all fits this description.

ServStor Sues Broadcom and MediaTek over Patents New to This Campaign

ServStor Technologies, LLC, an IPInvestments Group LLC (d/b/a IPinvestments Group) plaintiff, has sued Broadcom (2:24-cv-00761) and MediaTek (2:24-cv-00760) in separate Eastern District of Texas complaints. Broadcom is targeted over the provision of certain “servers, routers, and systems-on-a-chip (‘SoC[s]’) that manage internet connections and storage partitions”; MediaTek, of certain “microchips, servers, routers, ethernet switches, [SoCs], and ASICs”. At issue are features such as “accelerat[ing] the transmission of packets across a network”, “communicatively coupl[ing] an apparatus to a network”, and “transmit[ting] and encapsulat[ing] packets to a target device”.

Suit Against MediaTek Reopens the CommWorks Wireless Communications Campaign

Filed against TRENDnet in the Central District of California, the last open case in the wireless communications campaign of CommWorks Solutions, LLC ended (after a noticed settlement) in June 2024. There, CommWorks identified four nonparties having a pecuniary interest in the outcome: Brainbox Innovations, LLC (its parent, a fellow IP Investments Group LLC affiliate); “Invention Investment Fund I LLC” (presumably Invention Investment Fund I, L.P.) and “Invention Investment Fund II LLC” (presumably Invention Investment Fund II, LLC), both associated with Intellectual Ventures LLC (IV); and Kheyfits Belenky LLP (litigation counsel). Now, Rozier Hardt McDonough PLLC has filed an Eastern District of Texas complaint against MediaTek (2:24-cv-00701) for CommWorks in the same campaign.

DigiMedia Targets Automobile Surround-View Cameras and Virtual Assistants in Latest Complaints

So far in July, DigiMedia Tech, LLC—an entity associated with IP Investments Group LLC (d/b/a IPinvestments Group)—has expanded its litigation campaign over patents received from Intellectual Ventures LLC (IV) with suits against Hyundai (Kia) (2:24-cv-00510) and Mercedes Benz (2:24-cv-00531) in the Eastern District of Texas. The defendants are accused of infringement through the provision of automobiles that incorporate surround-view camera systems and virtual assistants.

DataCloud Campaign Nears 40 Defendants Sued with Latest Complaints

So far in July, DataCloud Technologies, LLC, an entity associated with monetization firm IPInvestments Group LLC (d/b/a IPinvestments Group), has added suits, both in the Eastern District of Texas, against Palo Alto Networks (2:24-cv-00482) and Zscaler (2:24-cv-00504) to the litigation campaign that it began back in June 2020. Six patents are asserted against Palo Alto Networks, four against Zscaler, all six of them received from Intellectual Ventures LLC (IV) and generally related to either file management or network communications. The new defendants are accused of infringement through the provision of products ranging from firewalls to website infrastructure solutions.

DigiMedia Tags Honda and HomeAway

Expedia Group (HomeAway) (1:24-cv-00767) and Honda (2:24-cv-00461) are the latest defendants to be added to the sole litigation campaign of DigiMedia Tech, LLC—an entity associated with IP Investments Group LLC (d/b/a IPinvestments Group)—which has sued over 25 defendants since May 2020. The plaintiff asserts two former Intellectual Ventures LLC (IV) patents against Honda, accused of infringement in an Eastern District of Texas complaint through the provision of Acura automobiles that incorporate surround-view camera systems; and four more IV patents against HomeAway, alleged in a Delaware complaint to infringe through functionality related to adding and deleting photos from a VRBO vacation rental listing using a mobile device.

Lenovo and ZTE Snagged in ServStor’s Third Round

ServStor Technologies, LLC, an IPInvestments Group LLC (d/b/a IPinvestments Group) plaintiff, has filed a third round of litigation in its sole campaign, accusing Lenovo (2:24-cv-00204) and ZTE (2:24-cv-00205) of infringing a familiar set of five former Intellectual Ventures LLC (IV) patents in separate Eastern District of Texas complaints. The defendants are accused of infringement through the provision of certain computer servers and racks, as well as related hardware and software products.

Relatively Routine Extension Request Denied

After adding separate cases against Allied Telesis and Samsara to its campaign over file management and/or network communications patents sourced from Intellectual Ventures LLC (IV), plaintiff DataCloud Technologies, LLC has sued HP (1:24-cv-00067) and Western Digital (1:24-cv-00156), both in the District of Delaware. Extensions of the deadline to respond to a new complaint are often routinely granted, to facilitate investigation of the allegations and resolution of the dispute in the earliest stages, but a relatively unusual denial was entered in one of DataCloud’s recent cases.

CDN Innovations and Sercomm File Dueling Complaints

This past December, CDN Innovations, LLC filed a Western District of Texas complaint against Sercomm (6:23-cv-00873), targeting the provision of networking products (e.g., gateways, modems, and routers) that implement port triggering with two patents generally related to detecting computer port inactivity. Early this year, Sercomm USA, a California-based subsidiary of the Taiwanese parent, filed a Northern District of California complaint against CDN Innovations (4:24-cv-00174). There, Sercomm USA seeks declaratory judgments of license, estoppel, and/or exhaustion for both patents, contending that CDN gave licenses and/or certain covenants to, or otherwise resolved claims against, Broadcom and MediaTek, asserting that because the accused products incorporate certain integrated circuits (ICs) and software from “Broadcom and/or MediaTek”, CDN is “barred, exhausted, and/or estopped” from alleging infringement.
