Two-Factor Authentication Campaign Spreads Beyond Banks

The second round of cases filed in the two-factor authentication campaign of Dynapass IP Holdings LLC indicates that the plaintiff has moved beyond accusations against just financial institutions. Last June, Dynapass sued nine such defendants, adding five more last week—one filed against each of Charles Schwab (2:23-cv-00064), East West Bancorp (East West Bank) (2:23-cv-00065), Experian (Experian Marketing Solutions) (2:23-cv-00066), First Citizens Bancshares (First Citizens Bank and Trust) (2:23-cv-00067), and Simmons First National (Simmons Bank) (2:23-cv-00068)—but also targeting Amazon (2:23-cv-00063) with the same expired patent. Three of the nine prior cases, all consolidated before Eastern District of Texas Judge Rodney Gilstrap, have ended, each after a noticed settlement.

Dynapass Targets Two-Factor Authentication in Online Banking Systems

Dynapass IP Holdings LLC, a subsidiary of Dynapass, Inc., has opened up a financial services campaign, asserting a single patent, generally related to authenticating a user through a “token” received on a “personal communication device”, against each of Bank of America (2:22-cv-00210), BOKF National (2:22-cv-00211), JPMorgan Chase (2:22-cv-00212), PlainsCapital Bank (2:22-cv-00213), PNC Financial (BBVA USA Bancshares) (2:22-cv-00214), Regions Financial (2:22-cv-00215), Truist Financial (2:22-cv-00216), Wells Fargo (2:22-cv-00217), and WoodForest National Bank (2:22-cv-00218). The support for two-factor authentication in the defendants’ respective online banking systems is targeted in each Eastern District of Texas complaint.
