Case Boomerangs to Judge Albright, Who Quickly Denies Contested Motion to Stay Pending EPR

Earlier this year, Western District of Texas Judge Lee Yeakel retired, joining King & Spalding as senior counsel. The cases over which Judge Yeakel presided at the time have since been farmed out to other judges, including a suit filed by inventor-controlled Identity Security LLC (f/k/a Integrated Information Solutions Corporation) against Apple (6:21-cv-00460). Then pending was an opposed Apple motion to stay the litigation to await the outcome of certain ex parte reexamination (EPR) proceedings before the USPTO. On June 7, the suit was reassigned to District Judge Alan D. Albright, who held an oral argument on June 16 and denied the motion on June 29.

Inventor-Controlled Texas Plaintiff Tags Apple over Secure Enclave
New Patent Litigation
Inventor-controlled Identity Security LLC (f/k/a Integrated Information Solutions Corporation) has filed its first litigation, suing Apple (6:21-cv-00460) in the Western District of Texas over the provision of the Secure Enclave system-on-chip (SoC) incorporated in various Apple devices, including Apple Watch, Apple TV, HomePod, iMac iPhone, and iPad-series products, as well as devices that feature the Apple T2 Security Chip. The plaintiff asserts four patents, generally related to a microprocessor for storing “digital identity data” and identifying the owner of a device.
