N5 Technologies Revives Litigation Campaign, Hits Additional Banks
N5 Technologies LLC has revived its litigation campaign by asserting the same patent (7,197,297) against the mobile banking services of two more banks, BB&T (2:15-cv-00447) and SunTrust (1:15:-cv-01310). The ‘297 patent relates to authentication of a mobile user via text message. In prior litigation against Capital One (1:13-cv-00386), an Eastern District of Virginia court issued a claim construction order requiring that the two steps of the asserted claims’ authentication process be performed in the order recited. Based on that ruling, the court granted Capital One summary judgment of non-infringement, which N5 did not appeal.

N5 Technologies Campaign Continues to Target Online Banking Services
Citigroup is N5 Technologies’s first new target in more than a year, but the suit (2:14-cv-00242) is part of the same campaign that the NPE began almost two years ago. As in previous cases, Citigroup’s mobile banking service is accused of infringing a single patent, the only patent asserted in this campaign (7,197,297). The patent-in-suit relates to sending a text message to a mobile device in order to confirm the authenticity of a user.
