Amid Announcement of a New Growth Strategy, Questions Remain About WiLAN’s Threat to Operating Companies
Energy, New Patent Litigation
Wi-LAN Inc. (WiLAN) has announced a seismic restructuring of its business model, de-emphasizing patent licensing and refocusing on the acquisition of Industrial Internet of Things (IIoT) businesses. Monday’s announcement follows a year in which WiLAN actively acquired patent portfolios from operating companies, including Eastman Kodak, GlobalFoundries, and Panasonic, boosting its patent portfolio to over 11,000 assets. It also comes after several other public NPEs, including Acacia Research Corporation and Unwired Planet (now Great Elm Capital Corp.) have made similar moves to diversify their activities.

Quantum Stream’s Serial Litigation Rolls On with New Suit Against Charter
Quantum Stream, Inc., a subsidiary of FORM Holdings Corp. (f/k/a Vringo, Inc.), seems to be developing a familiar pattern, filing a new complaint against Charter Communications (1:17-cv-01696) on the heels of a dismissal (without prejudice) in the case that it filed in November 2016 against Altice (Cablevision). The same three content distribution patents are again asserted (9,047,626; 9,117,228; 9,349,136), with Charter accused of infringement through the provision of digital entertainment systems through various identified receivers, including those sold under the Arris, Atlanta Scientific, Cisco, and Motorola brands, among others.

Suit Against Cablevision Follows a Settlement in Quantum Stream’s Content Distribution Campaign
Following a settlement with DIRECTV in September, Quantum Stream, Inc. has filed its second infringement suit to date. On November 4, the NPE—which is a subsidiary of FORM Holdings Corp. (f/k/a Vringo, Inc.)—lodged a complaint against Cablevision (including CSC Holdings and Neptune Holdings) (1:16-cv-08604), accusing the company’s digital entertainment systems of infringing three content distribution patents (9,047,626; 9,117,228; 9,349,136). In particular, Quantum is targeting Cablevision’s Optimum brand of services and products, and set-top boxes manufactured by Atlanta Scientific or Samsung, and used in connection with Optimum TV, are referenced in the complaint (although neither company is named as a defendant).

WiLAN, Vringo, and Endeavor IP Subsidiaries Add November 2015 Cases to Existing Campaigns
Throughout November 2015, an inordinate number of cases were filed by NPEs apparently motivated to get to court before December 1 to avoid changes to the Federal Rules of Civil Procedure that took effect on that date. Among those filing November cases were several subsidiaries of publicly traded patent assertion entities (PAEs), including Collabo Innovations, Inc. (a subsidiary of Wi-Lan Inc.); Iron Gate Security, Inc. (a subsidiary of Vringo, Inc.), and Endeavor MeshTech, Inc. (a subsidiary of Endeavor IP, Inc.).
