Recorded patent assignments recently made public reveal patents on the move, to an NPE that appears to be collecting assets from a familiar source as prior litigated patents run into PTAB trouble; to an entity managed by what appears to be a relatively new monetization operation standing up; to a recent entrant into the litigation funding space; to entities associated with a frequent plaintiff-side law firm in Texas; and to a host of other plaintiffs recently filing suit.

Litigation Funders Announce a Secondary Market Transaction Involving 15 IP Investments

Publicly traded litigation finance firm Omni Bridgeway announced this week that it had completed the sale of a 25% interest in a portfolio of 15 IP investments to another litigation funder, GLS Capital. While this type of deal is not entirely novel—e.g., Gerchen Capital Partners raised a $750M fund focused on buying positions in existing legal investments—the Omni Bridgeway-GLS transaction is particularly notable in light of the funders’ prominent positions in the patent monetization space.

Litigation Finance Injected with Additional Capital in Q3, as More NPEs Launch Campaigns with Third-Party Funding

Multiple litigation finance players announced large fundraises during the third quarter, signaling a continued interest in the asset class by institutional investors. Also during Q3, several NPEs began new campaigns financed by third parties, including an established litigation finance firm as well as a hedge fund.

MyPAQ Holdings Adds Dell to Campaign Litigating Former Flex Patents

MyPAQ Holdings Ltd. has followed up an April 2021 case against Samsung with a suit against Dell (6:21-cv-00933), also filed in the Western District of Texas. Two of the four power conversion patents-in-campaign are at issue against Dell, with infringement allegations in the new complaint targeting “power adapters and converters compatible with USB Type-C plugs”, calling out Dell’s LA90PM170. The deadline for Samsung to respond to MyPAQ’s complaint has been pushed into October.

Flex Patents Pop Up in Recent Assignments…and in New Funder-Backed Litigation

USPTO assignment records recently made public reveal multiple transfers, totaling more than 75 US assets, from subsidiaries of Flex (f/k/a Flextronics) to MyPAQ Holdings Ltd., a Seychelles entity that has just filed suit against Samsung (6:21-cv-00398). In the Western District of Texas complaint, MyPAQ accuses Samsung of infringing four of its new assets through the provision of certain chargers. Some familiar figures appear to be behind the new campaign.
