Fortinet Sued, Cisco Answers, in InfoExpress Litigation

In a Northern District of California complaint, InfoExpress, Inc. has filed a second case over a familiar set of six network access patents, accusing Fortinet (4:23-cv-04389) of infringing through the provision of its “Zero Trust Network Access Solutions including FortiNAC alone, and in combination with” FortiNet’s wireless access points, its routers and switches, and its “FortiNAC compliant hardware and virtual servers”. Prior defendant Cisco, sued in the Northern District of California this past May, has answered the complaint against it; InfoExpress’s new case has been filed in the same district where the plaintiff has identified for the court no nonparties having an interest in the outcome of the litigation.

Q2 in Review: New Third-Party Funded Patent Litigation

An RPX review of public records indicates that the second quarter of 2023 saw at least eight new patent infringement campaigns launched with the backing of third-party litigation funding. Also in Q2, several already existing third-party financed campaigns grew larger, with the plaintiffs hitting new defendants and/or going after familiar targets for a second or even third time.

Plaintiff Secures Funding—Only to File Suit Without Using Those Funds?

In a Northern District of California complaint, InfoExpress, Inc. has accused Cisco (3:23-cv-02698) of infringing six patents, generally related to controlling network access, through the provision of “hardware and software (including licenses)”, including Cisco’s Identity Services Engine (ISE), as access points, Secure Network Servers (SNS), and routers that implement the ISE. The plaintiff has certified that no nonparties have an interest, financial or otherwise, in the outcome of the litigation, even though other public filings suggest that InfoExpress entered into a “Funding Agreement” with a prominent provider of litigation finance this past February.
