Despite a Setback, Adaptix’s OFDMA Campaign Continues to Hit Device Makers and Wireless Carriers
The latest infringement suits filed by Adaptix, Inc. follow the usual format of the Acacia sub’s filings, naming as codefendants mobile device makers and wireless carriers. Amazon and AT&T are paired in one complaint, with Dell and Verizon (Cellco), and Sony and AT&T, in the other two complaints. The device makers’ computers, smartphones, and tablets, and the wireless carriers’ 4G LTE networks, are accused of infringing two patents related to orthogonal frequency division multiplexing (OFDM) data encoding (6,947,748, 7,454,212).

Defendants Score Victories in One Round of Adaptix Litigation, While the NPE Fires Off Another
Apple, AT&T, HTC, and Verizon scored double victories in Adaptix, Inc. litigations this month, only to be sued by the Acacia Research subsidiary again this week over the same patents. Since 2012, Adaptix has sued this group of companies multiple times (at least five times each) for alleged infringement of two patents related to orthogonal frequency division multiplexing (OFDM) data encoding (6,947,748, 7,454,212). In all the suits, the accused products are smartphones and/or tablets, with each complaint pairing a mobile device company (Apple or HTC) with a wireless carrier (AT&T or Verizon). All of the cases involve the ‘748 and ‘212 patents; some cases assert additional patents as well.

Adaptix Sues HTC and Two Carriers
Adaptix filed two new suits against HTC alongside wireless carriers AT&T and Verizon. Both cases involve two patents related to OFDMA communication (6,947,748, 7,454,212) and accuse HTC mobile handsets of infringement. Adaptix has asserted these same patents against a number of other mobile device manufacturers, including BlackBerry, Huawei, and ZTE, along with the service providers that sell those phones. The patents are part of a larger portfolio that Adaptix has been asserting since 2008. The entity’s litigation campaign significantly increased after it was acquired by Acacia Research in 2012. The patents-in-suit originated with Broadstorm Telecommunications and were transferred to Adaptix in 2004. Ericsson’s Base Stations Are Again the Target of Adaptix’s Campaign
Acacia’s Adaptix is going after Ericsson again, filing three suits against the mobile communication company and service providers Sprint, T-Mobile, and Verizon, which use Ericsson’s voice communication transceivers. The suits assert three patents related to OFDMA technology and communication (6,870,808, 6,904,283, 7,146,172) and accuse Ericsson’s Radio Base Stations of infringing the patents-in-suit. Adaptix previously sued Ericsson back in January 2013 in a suit that also involved AT&T and MetroPCS. The suit involved the same accused products and asserted the ’283 and ’172 patents. Discovery in that case is scheduled to conclude in June 2014. Four Adaptix Patents Assigned to Microsoft in January
March 22, 2012 - On March 2, 2012, Adaptix [NPE], a subsidiary of Acacia Research recorded the assignment of US patent numbers 7,164,669, 7,257,376, 7,414,994, 8,010,118 and pending US application 20110286351 to Microsoft on January 9, 2012. Adaptix has filed 12 suits thus far in 2012 against defendants including Alcatel-Lucent, Apple, AT&T, HTC, LG, Motorola Mobility, Nokia, Pantech, Sprint Spectrum, and Verizon, alleging that the defendants’ mobile phones, tablets, and 4G LTE services infringe seven patents related to OFDMA and 4G LTE technology. In January 2012, Acacia Research announced the acquisition of the Adaptix patent portfolio for $160 million and licensing agreements with Microsoft and Samsung. Acacia has reported that it executed license agreements totaling approximately $75 million in January 2012, and it is speculated that a large part of this revenue may have come from Microsoft and Samsung.
