Fatal Breaks in Patent’s Chain of Title Lead to Dismissal of NPE’s Wireless Router Suit
In litigation initiated by Mayfair Wireless, a Delaware district judge granted a motion to dismiss for lack of subject jurisdiction filed by Verizon, AT&T, T-Mobile, and Sprint. Mayfair sued the four cell phone carriers in September 2011 for alleged infringement of a patent related to transfer of data over wireless networks (6,587,441); defendants’ mobile hotspots were the accused products. Two months later, defendants sought dismissal of the suit on the grounds that Mayfair did not own the right, title, and interest of the ‘441 patent due to breaks in the chain of legal title.
