Judge Upholds Boston University’s Trial Win Against Semiconductor Companies, but Calls for a New Trial on Damages
After prevailing in a November 2015 trial over a semiconductor patent (5,686,738), the Trustees of Boston University subsequently moved to supplement its $13.7M win against Epistar, Everlight Electronics, and Lite-On (1:12-cv-11935) with an award of attorney fees, expert witness fees, and costs totaling over $11M, as well as enhanced damages. This past week, District Judge Patti B. Saris ruled on those motions as well as the defendants’ renewed motion for judgment as a matter of law and motion for a new trial or remittitur.

Update: Judge Upholds $13.7M Award to Boston University in Trial over LED Patent
This week, District Judge Patti B. Saris upheld a jury’s award of $13.7M to the Trustees of Boston University (BU), ruling that the university’s six-year delay in filing suit against Epistar and Everlight Electronics caused no economic harm to the defendants. In November 2015, a Massachusetts jury had found that Epistar and its customers Everlight and Lite-On infringed a BU semiconductor patent (5,686,738) through the manufacture and sale of certain LED products (1:12-cv-11935). Epistar and Everlight were found to have willfully infringed the ‘738 patent and were ordered to pay $9.3M and $4M, respectively, with Lite-On to pay $365K.

Jury Awards Boston University $13.7M in Trial over LED Patent
A Massachusetts jury found in favor of the Trustees of Boston University (BU), concluding that Epistar and two of its customers, Everlight and Lite-On, infringe a semiconductor patent (5,686,738) through the manufacture and sale of certain LED products (1:12-cv-11935). In a verdict handed down last week, the jury awarded BU a total of $13.7M in damages, with Epistar and Everlight (which were found to have willfully infringed the patent-in-suit), ordered to pay $9.3M and $4M, respectively, and Lite-On to pay $365K. According to court filings, BU has accused over 20,000 products of infringement since it initiated this campaign in October 2012, but the case against Epistar, Everlight, and Lite-On is the first to reach trial.
