RPost and Symantec Cross File Complaints on Same Day
Symantec filed a complaint for declaratory judgment this week against RPost and on the same day, the entity filed its own lawsuit alleging infringement against Symantec. Both cases involve five patents related to the transmission and receipt of electronic documents and the complaints both state that RPost has sent assertion letters to Symantec seeking a licensing agreement for the patents-in-suit (7966372; 8209389; 8224913; 8468199; 8504628). RPost is accusing Symantec’s email storage and encryption services of infringing the asserted patents while Symantec’s DJ filing seeks a ruling that it does not infringe the patents. Additionally, Symantec argues in its filing that the asserted patents are invalid. The patents-in-suit are asserted in a number of other RPost cases, some of which are still active. 1/15, Northern District of California, 5:14cv00238, 1/15, Eastern District of Texas, 2:14cv00028
