Settlement Terminates IPRs and Ends District Court Stays, Kickstarting e.Digital Campaign
e.Digital Corporation has filed its first lawsuits since January of this year. The publicly traded NPE’s new cases assert two patents (9,002,331; 9,178,983) against each of Netatmo (3:16-cv-05212), NETGEAR (3:16-cv-05211), and Y-Cam Solutions (3:16-cv-05215) while adding two more patents (8,311,522; 8,311,524) in the case against Netgear. The patents-in-suit generally relate to collecting information from one or more remote sensors to identify events requiring further attention, and the defendants networked cameras and remote monitoring systems are at issue in the campaign. e.Digital has both reopened stayed district court cases and filed these new ones in light of a settlement earlier this summer with Alphabet, ending prior district court cases against Dropcam and Nest Labs, as well as inter partes reviews (IPRs) brought by Google and its subsidiaries of six of the eight patents-in-campaign.

e.Digital Opposes Stay of Existing Case Against Dropcam, Adds New Suit Against Nest
e.Digital Corporation filed suit against a second Alphabet subsidiary, Nest Labs (3:16-cv-00375), in the Northern District of California. The new case asserts two patents (9,002,331; 9,178,983) from a family of eight generally related to collecting information from one or more remote sensors to identify events requiring further attention. Remote monitoring systems are at issue in the campaign.

Four New Suits Filed, Six IPRs Instituted, and Multiple Claim Terms Construed, All in e.Digital’s Wireless Camera Campaign
On December 17, 2015, a couple of weeks after a related claim construction order issued, e.Digital Corporation filed four more cases in its wireless camera campaign, hitting iBaby Labs (3:15-cv-05790), iSmart Alarm (4:15-cv-05793), MivaTek International (3:15-cv-05795), and MYFOX (3:15-cv-05798). The new complaints assert six patents (8,306,514; 8,311,522; 8,311,524; 8,315,618; 9,002,331; 9,178,983) from a family of eight, each of which has been asserted against at least one of the ten defendants now named in the litigation campaign. The patents-in-campaign generally relate to collecting information from one or more remote sensors to identify events requiring further attention, and alarm, baby, and other remote monitoring systems are accused of infringement.

More Flash Memory Manufacturers Sued in e.Digital Campaign
Continuing its litigation campaign, e.Digital Corporation filed ten new complaints, including against defendants HP, Microsemi, and SMART Modular Technologies. In recent months, the entity has asserted only a single patent and that same patent is asserted in the new cases (5,839,108). The ‘108 patent concerns a removable/interchangeable flash memory used in a handheld device. Flash memory storage products made or sold by defendants are at issue in the new suits, similar to the other accused products in the campaign.

e.Digital Campaign Grows to More Than 70 Cases
Acer, Apacer Technology, Cactus Technologies, Greenliant Systems, Lenovo, and Spansion are the most recent defendants added to e.Digital Corporation’s ongoing litigation campaign. The complaints accuse defendants’ tablets and PCs of infringing a single patent related to a removable and interchangeable flash memory that can be used in a handheld device (5,839,108). e.Digital has asserted the patent-in-suit in the majority of its lawsuits. The litigation campaign targets devices that incorporate flash memory storage, including cameras, computers, media players, mobile phones, and tablets.

New suits by e.Digital Corporation significantly expanded the entity’s newest campaign, which began in April with five cases. It now includes 38 new filings, against Accelerated Memory Production, ADATA, Advanced Media, ATP, BiTMICRO, C-One Technology, Cavalry Storage, Centon Electronics, Corsair, Delkin, Dexxon Groupe, Eye-Fi, Fusion-IO, G. Skill International, Intel, Kingston Technology, Mach Xtreme, Maxell, Micron Consumer Products (dba Lexar), Micron Technology, Mushkin, New Dane, OCZ Technology, Other World Computing, Patriot Memory, PNY Electronics, Seagate, SK Hynix, Strontium Americas, Super Talent Technology, Swissbit, Team Group, TOPRAM, Toshiba, Transcend Information, Verbatim, Western Digital, and Wintec.
