IP Edge’s Nitetek Campaign Weathers Patch of Turbulence
New Patent Litigation
When Nitetek Licensing LLC sued Continental (Zonar Systems) (1:22-cv-01015) as part of its end-of-July filing spree, the identity of the accused product remained unclear. The apparent IP Edge LLC plaintiff had filed with its District of Delaware complaint a claim chart that seemed better attached to a complaint of sister NPE Valyrian IP LLC, given that a copy of that chart was actually attached to a complaint that Valyrian IP filed against Gores AC Holdings (First Communications) on the same day. At the end of August, Nitetek swapped out the wrong exhibit for the right one in Delaware, dropping that case roughly a week later, but then two days later filed a second complaint against the same defendant (2:22-cv-01224)—a Western District of Washington complaint that itself appears to need correction as well.
