Federal Judges Confront Long Tail of Confusion from DynaIP’s Early Monetization Days

As RPX previously reported, the litigation operation associated with monetization firm Dynamic IP Deals, LLC (d/b/a DynaIP) created persistent confusion in its early days, as it moved from litigation by Illinois entities to litigation through Texas entities. Some of that confusion pervades a recently unsealed order from Western District of Texas Alan D. Albright shifting potentially $600K in attorney fees against plaintiff Silent Communication, LLC and its counsel Ramey LLP in a case filed against BlackBerry, at the same time that Fiserv has asked West Texas District Judge David Counts to clear away a cloud now hovering over the ownership of the patent family that AuthWallet, LLC, also repped by Ramey, has been litigating. The named inventor there has filed declarations with the USPTO suggesting that AuthWallet never actually owned that family.

“Silent Communication” Sues Three More, as BlackBerry Takes Aim at NPE’s Prior Complaint—and Its Litigation Counsel

In its new set of complaints—filed against 8x8 (FUZE) (6:22-cv-00531), Adobe (6:22-cv-00527), and Lifesize (6:22-cv-00529)—would-be patent plaintiff Silent Communication, LLC has correctly spelled its name after a previous typographical error put its prior litigation in jeopardy. However, questions remain about whether this Texas entity owns the patents asserted in this campaign. The ownership question, as well as additional questions about the conduct of litigation counsel here, Ramey LLP, have been raised in a motion to dismiss from the first defendant in the campaign, BlackBerry, sued in early March, also in the Western District of Texas.

Non-Existent Texas Silent Sues over a Patent That a Tel Aviv Silent Assigned to an Illinois Silent

A “Silent Communications, LLC”, purportedly a Texas entity, has sued BlackBerry (6:22-cv-00252) in the Western District of Texas over a patent generally related to the access, integration, and display of information from social networking sites by a mobile device. The patent has been litigated before—by Mobile Synergy Solutions, LLC (MSS), an NPE associated with Texas monetization firm Dominion Harbor Enterprises, LLC. A “Silent Communications, Inc.”, also purportedly a Texas entity, attempted to assert the same patent against BlackBerry last year—that case fizzled, perhaps given that the only company by that name in Texas lost its charter in that state in August 1999. Similar self-identity problems may persist, as Texas state records contain no “Silent Communications, LLC” today.
