Undeterred a Decade Later, KlausTech Takes Another Run at Google’s Internet Advertising Platform

Earlier this year, the Federal Circuit issued a summary affirmance (19-1536) of a final judgment in a case that KlausTech, Inc. (KTI) began in 2010 by filing against Admob, a company that Alphabet (Google) subsequently acquired. The parties had stipulated to noninfringement in light of a set of Northern District of California orders, construing claims, denying KTI’s motion to amend its infringement contentions, and striking portions of KTI’s expert reports. These several months later, KTI has transferred the asserted patent to a new owner, KlausTech LLC, through which it has renewed litigation against Google (4:20-cv-04459) in the Northern District of California, this time targeting features for creating and defining certain advertisement types in Google’s AdManager Internet advertising platform.
