Verify Smart Campaign Banks Two Additional Defendants

Over the past couple of months, Verify Smart Corp. has added cases against Valley National Bancorp (2:16-cv-06065) and Wells Fargo (2:16-cv-06389) to its now years-long campaign asserting a single patent (8,285,648) generally related to verification of user identity during an electronic transaction, with multi-factor systems for authenticating of that identity. The case against one of the last two defendants added to the campaign in early August, JP Morgan Chase (the other being Ally Bank), was dismissed without prejudice within three days of filing, following an established pattern of seeking voluntary dismissal shortly after a complaint’s filing.

Following dismissals in its most recent round of cases, Verify Smart Corp. has filed new complaints against Ally Bank (2:16-cv-04852) and JP Morgan Chase (2:16-cv-04853). The NPE again asserts a single patent (8,285,648) generally related to verification of user identity during an electronic transaction, with multi-factor systems for authenticating user identity accused of infringement.

Verify Smart’s Pattern of Filing and Quickly Dismissing Continues in 2016

Verify Smart Corp.’s pattern of filing and dismissing cases in short order continues in 2016. Earlier this month, two November 2015 suits, one each against Facebook and Yahoo, were voluntarily dismissed with prejudice. True to form, Verify Smart has filed another five, this time naming Basecamp (2:16-cv-00239), Dropbox (2:16-cv-00238), Salesforce (2:16-cv-00237), Twitter (2:16-cv-00235), and United Services Automobile Association (2:16-cv-00236). The new complaints, like the old, assert a single patent (8,285,648) generally related to verification of user identity during an electronic transaction. Multi-factor systems for authenticating user identity are the accused products.

Verify Smart Follows Another Dismissal with Yet Another New Filing
Verify Smart Corp. is filing fresh cases following its swift dismissals of Apple, Bank of America, HSBC, and Microsoft. Last week, it sued Facebook (1:15-cv-08673), and this week, it added Yahoo (2:15-cv-07965) to its sole litigation campaign. In each of its suits, including the most recently filed cases, Verify Smart asserts a single patent generally related to verification of user identify during an electronic transaction (8,285,648). Verify alleges that the defendants infringe the ‘648 patent through the use of a multi-factor system for authenticating user identity.

Verify Smart’s Fast-Moving Campaign Hits Facebook
After quickly ending cases against Apple, HSBC, and Microsoft, Verify Smart Corp. is now turning its attention to Facebook (1:15-cv-08673). Since initiating its sole litigation campaign in May 2014, Verify Smart has filed six cases against five companies, asserting a single patent generally related to verification of user identity during an electronic transaction (8,285,648). In this week’s filing, as in each of its previous suits, Verify Smart alleges that Facebook infringes the ‘648 patent through the use of a multi-factor system for authenticating user identity.

Apple Is Newest Target in Verify Smart’s Campaign
Apple is the newest target of Verify Smart Corp.’s litigation campaign, which just began targeting technology companies last month. A single patent is asserted in the campaign (8,285,648). The patent concerns verifying a user’s identity during an electronic transaction. Multi-factor authentication systems have been the accused products throughout the campaign, and that focus continues in the new suit (2:15-cv-06207), as Apple’s two-step verification is accused of infringement.

Verify Smart Sues Microsoft in Campaign That Previously Targeted Banks
Verify Smart Corp. turned its attention from financial institutions to sue Microsoft in its most recent filing. The suit (2:15-cv-05596) is part of Verify’s existing campaign, asserting a single patent that concerns verifying a user’s identity during an electronic transaction (8,285,648). Microsoft’s multi-factor authentication system for verifying a user during an electronic transaction is accused of infringing the patent-in-suit. Similar products are accused in the other suits in the campaign. Other defendants in Verify’s sole litigation campaign are Bank of America and HSBC. The suit against HSBC was voluntarily dismissed, without prejudice, on August 14, 2014, within three months of filing and on the same day that the original case against Bank of America was filed. On June 30, 2015, Judge Katharine S. Hayden granted Bank of America’s motion to dismiss, ruling that Verify had failed to plead facts sufficient to establish that it had the right to sue, as patent owner or exclusive licensee, on the date of the complaint. The original case against Bank of America was dismissed. Verify filed a second lawsuit against Bank of America on July 9, 2015, this time alleging full ownership of the patent-in-suit.

Failed Internet Security Company Now Suing Banks over Secured Transactions
Bank of America is the second target of Verify Smart Corp., a former operating company that filed its first suit, against HSBC, in May of this year. That suit was voluntarily dismissed, without prejudice, on the same day that Verify filed the current case (2:14-cv-05117) against Bank of America. Both suits assert a patent related to verifying a user’s identity during an electronic transaction (8,285,648). Bank of America’s fraud protection system that enables secure banking transactions from a mobile device is accused of infringing the patent-in-suit.
