USPTO Records Released in Second Half of June Feature Assignments to Familiar NPEs
RPX took notice, among the assignment records published by the USPTO during the latter half of June, of the transfer of patents to several repeat players in patent litigation, including IP Edge LLC and Cerinet USA Inc. Also of note were two NPE-to-NPE transactions, from Intellectual Ventures LLC to IQ Holdings, LLC, and between M2M Solutions LLC and Blackbird Tech LLC.

Large OpCos Among the Assignors in Patent Transfers Seen During the First Half of April
RPX took notice, among the USPTO assignment records made available during the first part of April, of the transfer of patents from operating companies including GlobalFoundries, NXP Semiconductors, Panasonic, and Toshiba. Also noted was an assignment of nearly 950 patents from Intellectual Ventures LLC to Monument Patent Holdings, LLC (one of the Top Ten NPEs in 2016, by defendants added and new campaigns filed). While some of April’s transactions involved patents that have already been litigated, most involve assets not yet seen in litigation, suggesting that the launch of several new campaigns is imminent.

Content Distribution Patents Asserted Again in Litigation, This Time by Monument Subsidiary
Pure Data Systems, LLC, a subsidiary of Monument Patent Holdings, LLC, has launched a new campaign over two patents (5,999,947; 6,321,236) generally related to the distribution of database differences and previously asserted in litigation. Pure Data’s complaints accuse CBS (CBS Interactive, CNET) (6:17-cv-000210), Time Warner (CNN Interactive) (6:17-cv-000209), Twenty-First Century Fox (Fox Broadcasting, Fox News, Fox Sports) (6:17-cv-000211), and USA Today (6:17-cv-000208) of infringement through the process by which content delivered to their websites and mobile apps is replicated across multiple servers. Xanthus Data Technologies, LLC, an affiliate of Daniel F. Perez, asserted both patents against Citrix and LinkedIn in a short-lived 2015 litigation campaign.

Multiple Large OpCos Among the Assignors in Patent Transfers Seen During the Second Half of February
RPX took notice, among the USPTO assignment records made available during the latter part of February, of the transfer of patents from operating companies Dongbu, Eastman Kodak, Honeywell, IBM, and Koninklijke Philips to various NPEs. One of those NPEs (Uniloc Corporation Pty. Limited) has already launched a campaign asserting the patents that it received (from IBM). RPX also saw during this time the recordation of the assignment of one two-way radio patent from one litigating NPE to another (the second, an affiliate of IP Edge LLC) and the assignment of two database management patents from a Daniel F. Perez entity that asserted them in litigation back to the Georgia patent monetization firm from which that NPE acquired them.

NPEs Managed by IP Valuation Partners Launch Seven Litigation Campaigns in 2015
Since April 2015, seven NPEs managed by two partners at IP Valuation Partners LLC have collectively filed over 30 patent infringement suits against operating companies. Six of these NPEs were incorporated in Texas in 2015. (Gene Reader LLC was incorporated in Texas in 2014.) Each NPE is managed by IP Valuation’s Jason Bourgeois (a former patent agent trained in biomedical engineering) or Jonathan Szarzynski (a former patent licensing director at IPNav). Spangler Law P.C. represents all seven of the NPEs in litigation.

Daniel Perez Debuts New NPE with Suits Against Citrix, LinkedIn
A new Daniel Perez entity, Xanthus Data Technologies, LLC, filed suit against Citrix (2:15-cv-00715) and LinkedIn (2:15-cv-00777). The entity asserts two patents, both of which relate to database management (5,999,947, 6,321,236). The patents-in-suit originated with Arkona, Inc. and were assigned to Intellectual Ventures Asserts 13 LLC in March 2015. In April of this year, the patents were assigned first to IQ Holdings, LLC and then to Xanthus. They have not been previously asserted in litigation. Many of Citrix’s cloud-based products are accused of infringing the patents-in-suit.
