Equitable IP’s Push Notification Campaign Nears 50 Defendants Sued

Push Data LLC, an entity associated with Equitable IP Corporation, has added a slew of defendants to its sole litigation campaign, suing Elliott Capital Advisors (Barnes & Noble, Nook Digital) (4:24-cv-00120), First Community Bancshares (4:24-cv-00128), First Watch Restaurants (4:24-cv-00129), Macy’s (4:24-cv-00121), Nekter Juice Bar (4:24-cv-00130), Office Depot (4:24-cv-00131), PacSun (4:24-cv-00123), PGA Tour (4:24-cv-00124), Progressive (4:24-cv-00125), and State Farm (4:24-cv-00126), all in the Eastern District of Texas. The four patents-in-suit, asserted in overlapping sets, generally relate to sending information to a mobile device based on user preference and location. The defendants are accused of infringement through the support of push notification features in their respective mobile apps.

Equitable IP Plaintiff Pushes Out Eight More Eastern District of Texas Complaints

After suing ASICS, American Eagle, Gartier (Zara), H&M, Kering (Gucci), Planet Fitness, and Zumiez this past October, Push Data LLC hit Citibank (4:23-cv-01117), Costco (4:23-cv-01119), Exxon Mobile (4:23-cv-01120), Kroger (4:23-cv-01121), Mahwah Bergen Retail (Lane Bryant) (4:23-cv-01122), Nordstrom (4:23-cv-01123), Rent-A-Center (4:23-cv-01124), and Wayfair (4:23-cv-01126), each in the Eastern District of Texas. Up to four patents generally related to sending information to a mobile device that is related to a user preference and also based on the user’s location are asserted, with infringement allegations throughout targeting the provision of mobile apps, websites, and/or desktop applications that support push notifications.

Assertion Baton Passed from One Mobile App Campaign to Another

For the second time this year, Aido Mobility LLC, an NPE associated with Texas monetization firm Endpoint IP LLC, has handed off a chunk of its patent portfolio to an entity apparently associated with Equitable IP Corporation. The recipient, Push Data LLC, has just launched a campaign over the received assets, suing a slew of restaurants, hotel chains, and retailers in the Eastern District of Texas: Burger King (4:20-cv-00776), Chipotle (4:20-cv-00777), Dunkin Donuts (4:20-cv-00778), Hilton Worldwide (4:20-cv-00779), Inter-Continental Hotels (4:20-cv-00785), Jack in the Box (4:20-cv-00780), Panera Bread (4:20-cv-00781), Papa Johns (4:20-cv-00782), REI (4:20-cv-00783), and Wendys (4:20-cv-00784).
