Latest IPVal Campaign Sets Its Sights on Rangefinders, with Firm Activity Suggesting Additional, Imminent Litigation

This past December, Ranging Optics LLC, a plaintiff associated with Texas monetization firm IPValuation Partners, LLC (d/b/a IPVal), kicked off its first litigation campaign, suing Bass Pro Group (Cabelas) (6:20-cv-01103) over the provision of the Intensity 1600 Rangefinder and Nikon (2:20-cv-11658) over the provision of the Monarch 3000 Stabilized rangefinder. Two signal detection patents, received from Asia Optical in September 2020, are asserted in the complaints, the second of which, against Nikon, was filed in the Central District of California, where Ranging Optics has filed a generic corporate disclosure but has yet to file a certificate identifying any nonparties with an interest in the outcome of the litigation.

2020 Marketplace Trends: Former Operating Company Patents Remain a Strong Driver of NPE Litigation

As extensively reported by RPX, the acquisition and assertion of operating company patents by NPEs remained a significant driver of litigation throughout 2020. Be prepared for this long-term trend to possibly accelerate as a result of the COVID-19 recession. If past is prologue, the current financial crisis will likely be followed by years of increased patent divestments by operating companies—including to NPEs.

Late October saw a number of patent assignments to NPEs recorded with the USPTO. The assignees included publicly traded NPE Quest Patent Research Corporation (QPRC) as well as entities associated with monetization firms Harfang IP Investment Corp (d/b/a Harfang IP) and IPValuation Partners LLC (d/b/a IPVal).
