New Patent Litigation

A single patent generally related to monitoring human physical activity is asserted throughout, the claims of the patent having survived several inter partes reviews (IPRs) and having been construed in a January 2021 Markman order from District of Kansas Judge Eric F. Melgren, who is presiding over an earlier case, against Garmin.

The suits follow a claim construction ruling in a long-stayed dispute with Garmin that sprung back to life after unsuccessful inter partes reviews (IPRs) of the patent, which generally relates to monitoring human physical activity.

The NPE asserts the same patent—generally related to a device worn by an individual that measures, analyzes, and records data about the individual’s body movements using an accelerometer, programmable microprocessor, internal clock, and memory—at issue in the other active case in the campaign, a District of Kansas suit still in early stages against Garmin. The first defendant, Fitbit, settled in November 2016, leading to a dismissal from the Northern District of California in early 2017.
