Under a New Agreement with Fortress, Marathon Will Need More Cash—and Quick
Per a recently signed debt restructuring plan, publicly traded NPE Marathon Patent Group, Inc. has three months to pay Fortress Investment Group LLC over $15M. With just around $500K cash on hand, Marathon—which on May 15 reported Q1 2017 revenue of just $78K—may be hard pressed to find the funds needed to meet that deadline.

Marathon’s TLI Communications Files Actions in France and Italy Against Yahoo and Pinterest
This week, TLI Communications GmbH, a subsidiary of the publicly traded NPE Marathon Patent Group, Inc., launched new attacks on Yahoo and Pinterest, this time in French and Italian courts. TLI’s latest filings come four months after a court in Munich, Germany ruled that Yahoo, its European subsidiary Yahoo! EMEA Limited, and Pinterest have infringed European patent EP 0 814 611.

German Court Issues Infringement Ruling and Injunctions Against Yahoo, Pinterest in Marathon Subsidiary Case
A German district court has issued patent infringement rulings against Yahoo and Pinterest in proceedings brought by TLI Communications GmbH, a subsidiary of the publicly traded American NPE Marathon Patent Group, Inc. In two rulings on April 21, 2016, Munich District Court I issued multiple decisions finding that Yahoo and its European subsidiary, Yahoo! EMEA Limited, had infringed European patent EP 0 814 611 through their Flickr service, and Pinterest through its own eponymous service. The patent-in-suit—the counterpart to US patent 6,038,295—generally relates to a camera phone that adds metadata to pictures and sends them to a server, which then uses the metadata to determine where to file the images. As typically occurs in German patent cases, the court issued injunctions as well as a finding of liability for damages.
