Abstract

An apparatus for and a method of analyzing intellectual property (IP) is provided. In accordance with a preferred embodiment of the invention, an apparatus (and corresponding method) is provided for linking information regarding intellectual property (e.g., patents, trademarks, copyrights, trade secrets, etc.), items of trade (e.g., products, services, etc.), and analysis (e.g., technical, legal, interpretative, etc.). In an exemplary embodiment, an intellectual property analyzer may be provided with one or more modules (e.g., identifier module, report generator, linking module, etc.) to automatically and manually retrieve, gather, compile, store and process information for performing and reporting analysis of intellectual property.

Claims

1. A method of associating intellectual property with an item of trade (IOT), the method comprising the steps of:

(a) storing intellectual property information;

(b) storing IOT information concerning an item of trade (IOT); and

(c) associating stored intellectual property information with stored IOT information.

2. The method of associating intellectual property as recited in claim 1, further comprising step (d) displaying IOT information related to a first IOT, said displaying step (d) comprising the steps of:

receiving an input selection of one of a plurality of views of the first IOT; and

displaying the selected view of the first IOT, together with intellectual property information associated with the first IOT.

3. The method of associating intellectual property as recited in claim 2, wherein said storing step (b) further comprises the step of storing a plurality of multimedia information files containing information regarding IOTs in alternative formats including audio and video;

and

wherein said displaying step (d) further comprises the step of displaying selected ones of the plurality of multimedia information files pertaining to the first IOT.

4. The method of associating intellectual property as recited in claim 3, wherein the IOT information stored in said storing step (b) include information regarding products and services provided by a first company;

and wherein said intellectual property information stored in said storage step (a) include intellectual property owned by the first company.

5. The method of associating intellectual property as recited in claim 1, wherein said storing step (a) comprises the step of storing intellectual property information in IP data records respectively corresponding to individual intellectual property.

6. The method of associating intellectual property as recited in claim 5, wherein said associating step (c) includes adding a first IOT identifier to each IP data record that is to be associated with the first IOT.

7. A method of analyzing intellectual property, the method comprising:

storing at least a first intellectual property (IP) record representing at least one intellectual property;

inputting and storing a first interpretive analysis of at least a first portion of the intellectual property represented by the first IP record; and

correlating the first interpretive analysis with at least a first item of trade (IOT).

8. The method of analyzing intellectual property as set forth in claim 7, further comprising:

associating at least the first IP record with at least the first IOT;

selecting a first one of a plurality of hierarchical views representative of the first IOT; and

visualizing the first hierarchical view, the first IP record, and the first interpretive analysis.

9. The method of analyzing intellectual property as set forth in claim 8, wherein the first hierarchical view represents an IOT in the form of a product as a whole, the method further comprising:

selecting a second one of the plurality of hierarchical views representative of the first IOT, wherein the second hierarchical view represents a plurality a components making up the product as a whole; and

visualizing substantially simultaneously the second hierarchical view, together with a second IP record and a second interpretive analysis, wherein the second IP record identifies a second intellectual property which is associated with at least one of the plurality of components in the second hierarchical view, and the second interpretive analysis includes analysis of the second intellectual property identified by the second IP record.

10. The method of analyzing intellectual property as set forth in claim 7, wherein the first IP record represents a first patent, and the first interpretive analysis represents a claim analysis of a claim of the first patent, the method further comprising:

generating a claim chart presenting a claim of the first patent and the claim analysis.

11. The method of analyzing intellectual property as set forth in claim 10, wherein the first patent is a U.S. utility patent, and the first interpretive analysis represents an infringement analysis of the claim of the first patent with respect to the first IOT.

13. The article of manufacture of claim 12, wherein said storing step (e) further comprises storing a secure identification of each user upon submission by the user of input with respect to the first IP unit.

14. The article of manufacture of claim 13, the executable program is executed to further perform the steps of:

controlling access by the plurality of users of input submitted for the first IP unit;

monitoring input submitted by the plurality of users for the first IP unit, and selecting at least one input for unrestricted access by the plurality of users when viewing the first IP unit.

15. The article of manufacture of claim 14, the executable program further comprising the step of tracking the identity of each user submitting input that has been selected for unrestricted access in said monitoring step.

17. The intellectual property analyzer as recited in claim 16, wherein said identifier module automatically assigns identifiers to intellectual property information stored in said intellectual property storage unit, the identifiers including references to country, project, product and division.

18. The intellectual property analyzer as recited in claim 16, wherein said identifier module assigns identifiers to intellectual property information based on user input.

19. The intellectual property analyzer as recited in claim 16, further comprising a report generator, wherein said report generator outputs reports listing intellectual property information based on selected identifiers.

20. The intellectual property analyzer as recited in claim 19, wherein said report generator outputs reports to a video display on a user interface.

21. The intellectual property analyzer as recited in claim 19, wherein said report generator outputs reports in the form of an e-mail message.

12. In a computer system comprising:

at least one storage unit, at least one processor unit, and at least one user interface, the improvement comprising an article of manufacture having stored thereon an executable program operative to effectuate analysis of intellectual property information in connection with the computer system, wherein the executable program is executed to perform the steps of;

(a) retrieving at least a first intellectual property (IP) unit;

(b) tagging the first IP unit with one of a plurality of labels;

(c) linking the first IP unit to each of plurality of product/service information units stored in at least one database;

(d) presenting at least a first one of the product/service information units on the user interface with an indication of linkage between the first IP unit and the first product/service information unit; and

(e) storing input submitted from individual ones of a plurality of users with respect to given product/service information units and given IP units.

16. An intellectual property analyzer comprising:

an intellectual property storage unit, wherein said intellectual property storage unit stores intellectual property information; and

an identifier module, wherein said identifier module assigns identifiers to intellectual property information stored in said intellectual property storage unit.

22. An intellectual property analysis system comprising:

an intellectual property storage unit, wherein said intellectual property storage unit stores intellectual property information;

an item of trade (IOT) storage unit, wherein said IOT storage unit stores information related to IOTs; and

an analyzer server, coupled to said intellectual property storage unit and said IOT storage unit, said analyzer server comprising;

an identifier module, wherein said identifier module assigns selected identifiers to intellectual property information stored in said intellectual property storage unit; and

a report generator, wherein said report generator outputs reports based on links between an input IOT and intellectual property linked to the input IOT.

23. The intellectual property analysis system as recited in claim 22, further comprising an analysis storage unit, wherein said analysis storage unit stores descriptive analysis related to intellectual property information and IOT information.

24. The intellectual property analysis system as recited in claim 23, wherein the descriptive analysis stored in said analysis storage unit is input through a user interface, and includes technical, legal and interpretive analysis information.

25. The intellectual property analysis system as recited in claim 24, wherein said report generator generates a document in the form of a written legal opinion incorporating the technical, legal and interpretive analysis information relative to a given IOT and a given intellectual property.
