Abstract

A method and apparatus for identifying, tracking and monitoring digital media files is provided. The system provides numerous methods of interfacing with a content outlet. The methods further include comparing attributes of content to be downloaded with attributes of content in a media database. The methods also includes providing restrictions based on a result of the comparing. The methods further include monetizing the methods between both retailers and rights-holders using the system. Additionally, the method may include providing retail analysis, resolving disputes, and distributing royalty payments to rights-holders of content.

Claims

1. An online digital rights management system comprising:

an open copyright database storing file information for a plurality of media files, for each file said file information including file title, hashing information identifying a source of said file, fingerprint information, and a file state;

a client access server coupled to a network, said client access server managing said open copyright database, wherein said client access server instantiates a batch loading process, a self-registration process, a p2p client interface process, an accounting process, and a rightsholder file management process; and

a web crawler operable to search the network and uncover media files.

2. The online digital rights management system of claim 1 wherein the p2p client interface process uncovers media files.

3. The online digital rights management system of claim 2 wherein the client access server compares file information for the uncovered files to the file information stored in the open copyright database.

4. The online digital rights management system of claim 3 wherein the client access server determines if the uncovered media file is currently stored in the open copyright database.

5. The online digital rights management system of claim 4 wherein the uncovered media file is added to the open copyright database if the media file is not currently stored in the open copyright database.

6. The online digital rights management system of claim 3 wherein the uncovered media file is displayed to a rightsholder when the file information of the uncovered media file closely matches the file information of a stored media file within the open copyright database.

7. The online digital rights management system of claim 6 further comprising a track listening service wherein the rightsholder may listen to the uncovered media file.

8. The online digital rights management system of claim 1 wherein all the media files a rightsholder owns are displayed in the rightsholder file management process.

9. The online digital rights management system of claim 1 wherein media files with disputed rights are displayed to a rightsholder in the rightsholder file management process.

10. The online digital rights management system of claim 1 wherein the accounting process generates billings based on the sale of a rightsholder'"'"'s owned media files.

11. A method of managing an online digital rights management system comprising:

providing an open copyright database storing file information for a plurality of media files, for each file said file information including file title, hashing information identifying a source of said file, fingerprint information, and a file state;

providing an interface for a user to access the open copyright database, wherein providing the interface enables a self-registration process;

a p2p client interface process;

an accounting process; and

a rightsholder file management process;

receiving and storing in the open copyright database known files from a rights-holder during the self-registration process;

receiving unknown files during the p2p client interface process;

fingerprinting and storing unknown files in a missing masters list in the open copyright database;

comparing and matching unknown files to a rights-holders'"'"' known files in the rights-holder file management process;

displaying to a rights-holder potentially matched unknown files;

providing a track listening service to enable a rights-holder to listen to a matched unknown file;

monitoring the sale of matched unknown files and known files of a rightsholder; and

determining royalties from the sale of known and matched unknown files in the accounting process.

12. The method of managing an online digital rights management system of claim 11 further comprising;

allowing a rights-holder to assert rights to a matched unknown file.

13. The method of managing an online digital rights management system of claim 11 wherein the self-registration process includes receiving a batch loading of known files.

14. The method of managing an online digital rights management system of claim 11 wherein the rights-holder file management process allows the rights-holder to assign rules and categories to the file.

15. The method of managing an online digital rights management system of claim 11 wherein the file information for each unknown file is compared to the file information for each known file.

16. The method of managing an online digital rights management system of claim 11 further comprising;

providing a file searching process to the rights-holder.

17. The method of managing an online digital rights management system of claim 11 wherein the files are ordered by popularity while displaying to a rights-holder potentially matched unknown files.

18. The method of managing an online digital rights management system of claim 11 further comprising;

providing an interface for retailers.

19. The method of managing an online digital rights management system of claim 11 further comprising;

providing an interface to resolve rights disputes.

20. The method of managing an online digital rights management system of claim 19 wherein royalties are held in escrow during a dispute.

21. A database for storing digital files and associated metadata, wherein the metadata for each digital file includes data fields for storing:

a file title;

artist information;

hashing information identifying a source of the file;

fingerprint information of the file;

ownership rights of the file;

rules pertaining to the file; and

a file category.

22. The database for storing digital files of claim 21 wherein a rightsholder may access all the data fields of the database.

23. The database for storing digital files of claim 22 wherein a retailer can not access all the data fields of the database.

24. The database for storing digital files of claim 21 wherein all the data fields may be searched with an interface.

25. The database for storing digital files of claim 24 wherein the rules pertaining to the file include restrictions on the sale of the file.

26. The database for storing digital files of claim 23 wherein the rules pertaining to the file include countries where the file may be sold.

27. The database for storing digital files of claim 26 wherein the information in the data fields is entered manually.

28. The database for storing digital files of claim 21 wherein the file and information in the data fields is automatically stored while monitoring file transactions over a computer network.

29. The database for storing digital files of claim 21 wherein the information in the data fields may be accessed in a real-time basis.

30. The database for storing digital files of claim 21 wherein the ownership rights information includes disputed rights.

31. An interface providing a rights-holder access to an open copyright database of files comprising:

providing an overview interface screen;

providing a use terms interface screen;

providing a catalog interface screen; and

providing an account interface screen.

32. The interface of claim 31 wherein the overview interface screen displays registered files and disputed files.

33. The interface of claim 31 wherein the account interface screen displays user account contact information.

34. The interface of claim 31 wherein the catalog interface screen displays file title, artist and rights information.

35. The interface of claim 31 further comprising:

providing an all works interface screen.

36. The interface of claim 35 wherein the all works interface screen displays a list of potentially owned files.

37. The interface of claim 31 wherein the list of potentially owned files is displayed in order of popularity.

38. The interface of claim 31 wherein the use terms interface screen provides a display of rules associated with the use of a file.

39. The interface of claim 31 wherein the account interface screen provides a display of royalties.

40. The interface of claim 31 wherein the interface is operably connected to a server and a database.

41. A method of managing an online digital rights management system for stored digital media files comprising:

determining licenses for digital media using multiple fingerprint technologies based on the type of media requested;

determining, in real-time, the licenses that are available to digital media distribution services based on the capability of the digital media distribution services to handle licensing restrictions;

enabling the filtering (banning) of certain media files on third-party distributed systems;

determining, in real-time, the affects on income due to potential changes in licenses of online media;

modifying the available licenses for media files in real-time and causing the modified licenses to propagate to all participating media distribution services immediately;

providing time-based and limited licensing restrictions for digital media based on time of day, promotional periods, number of users who have the digital media file, etc. that are only made available to online media distribution services when the restrictions for the licenses are met by a system; and

determining, in real-time, the licenses that are available to digital media distribution services based on the consumer'"'"'s country of origin.
