1. A surgical stapler comprising:
- a shaft extending along a longitudinal axis, the shaft having a proximal end and a distal end;
an actuator positioned at the proximal end of the shaft;
a staple pusher extending longitudinally along the shaft and movable longitudinally with respect to the shaft; and
a jaw assembly positioned at the distal end of the shaft, the jaw assembly comprising;
a first jaw; and
a second jaw opposite the first jaw and movable with respect to the first jaw to define an open configuration of the jaw assembly wherein the first jaw is spaced apart from the second jaw and a closed configuration of the jaw assembly wherein the first jaw is adjacent the first jaw; and
wherein the actuator is operatively coupled to the staple pusher and operatively coupled to the jaw assembly such that from an open configuration of the jaw assembly, a first actuation stroke of the actuator advances the jaw assembly to the closed configuration and a second actuation stroke of the actuator advances the staple pusher longitudinally distally with respect to the shaft.

Abstract
A surgical stapler is provided that maintains the jaws of the stapler in an open position and prevents firing of staples when a cartridge is not loaded in one of the jaws. Distinct positioning and sequencing of the jaws, capture pin and firing of the staples are provided by a latch mechanism. Such locking and latching mechanisms ensure proper operation of the stapler.

a shaft extending along a longitudinal axis, the shaft having a proximal end and a distal end; an actuator positioned at the proximal end of the shaft; a jaw assembly positioned at the distal end of the shaft, the jaw assembly comprising; a first jaw; a second jaw opposite the first jaw and movable with respect to the first jaw and with respect to the shaft to define an open configuration of the jaw assembly wherein the first jaw is spaced apart from the second jaw and a closed configuration of the jaw assembly wherein the first jaw is adjacent the first jaw; and a capture pin positioned at least partially in the second jaw and selectively extendable from the second jaw towards the first jaw; and a latch mechanism operatively coupling the actuator to the jaw assembly, the latch mechanism having an open position in which the jaw assembly is in the open configuration, a capture position in which the capture pin is extended from the second jaw towards the first jaw, and a closed position in which the jaw assembly is in the closed configuration, the latch mechanism comprising a first stop restricting movement of the latch mechanism from the capture position to the open position, and a second stop restricting movement of the latch mechanism from the closed position to the capture position. - View Dependent Claims (9, 10, 11, 12, 13, 14, 15, 16)

17. A surgical stapler comprising:

a shaft having a proximal end and a distal end; a trigger assembly positioned at the proximal end of the shaft; an end effector assembly positioned at the distal end of the shaft, the end effector assembly comprising; a first end effector; a second end effector opposite the first end effector, the second end effector adapted to receive one or more staples, and the second end effector movable with respect to the first end effector and with respect to the shaft to define an open configuration of the end effector assembly wherein the first end effector is spaced apart from the second end effector and a closed configuration of the end effector assembly wherein the first end effector is adjacent the first end effector; and a capture pin positioned at least partially in the second end effector and selectively extendable from the second end effector towards the first end effector; and a support member slidable with respect to the shaft and operatively coupling the trigger assembly to the second end effector; a capture pin pusher operatively coupling the trigger assembly to the capture pin; and a firing lever operatively coupling the trigger assembly to the one or more staples; and wherein the trigger assembly is operatively connected to the support member, the capture pin pusher, and the firing lever such that for a first actuation stroke of the trigger assembly, the trigger assembly actuates the capture pin pusher and the support member and for a second actuation stroke of the trigger assembly, the trigger assembly actuates the firing lever. - View Dependent Claims (18, 19, 20)
