1. A stapler comprising:
- a shaft extending along a longitudinal axis and having a proximal end and a distal end;
a jaw assembly positioned at the distal end of the shaft, the jaw assembly comprising;
a first jaw;
a second jaw arranged to receive a staple cartridge; and
a staple pusher movable within the second jaw;
wherein the second jaw is movable along the longitudinal axis from an open position spaced apart from the first jaw towards the first jaw to a closed position wherein the second jaw is positioned adjacent the first jaw; and
an actuator connected to the proximal end of the shaft, the actuator comprising;
a stationary handle housing; and
a movable trigger connected to the stationary handle housing, the trigger movable in a first stroke to move the second jaw from the open position to the closed position and in a second stroke to move the staple pusher within the second jaw; and
a firing lever having a first end and a second end opposite the first end, the first end pivotally connected to the actuator, and the second end operatively coupled to the staple pusher, wherein the firing lever is oriented transverse to the longitudinal axis during the first stroke of the trigger and wherein the firing lever is substantially aligned with the longitudinal axis during the second stroke.

Abstract
A surgical stapler is provided that maintains the jaws of the stapler in an open position and prevents firing of staples when a cartridge is not loaded in one of the jaws. Distinct positioning and sequencing of the jaws, capture pin and firing of the staples are provided by a latch mechanism. Such locking and latching mechanisms ensure proper operation of the stapler.

1. A stapler comprising:

a shaft extending along a longitudinal axis and having a proximal end and a distal end; a jaw assembly positioned at the distal end of the shaft, the jaw assembly comprising; a first jaw; a second jaw arranged to receive a staple cartridge; and a staple pusher movable within the second jaw; wherein the second jaw is movable along the longitudinal axis from an open position spaced apart from the first jaw towards the first jaw to a closed position wherein the second jaw is positioned adjacent the first jaw; and an actuator connected to the proximal end of the shaft, the actuator comprising; a stationary handle housing; and a movable trigger connected to the stationary handle housing, the trigger movable in a first stroke to move the second jaw from the open position to the closed position and in a second stroke to move the staple pusher within the second jaw; and a firing lever having a first end and a second end opposite the first end, the first end pivotally connected to the actuator, and the second end operatively coupled to the staple pusher, wherein the firing lever is oriented transverse to the longitudinal axis during the first stroke of the trigger and wherein the firing lever is substantially aligned with the longitudinal axis during the second stroke. - View Dependent Claims (2, 3, 4, 5, 6)

7. A surgical stapler comprising:

a shaft extending along a longitudinal axis, the shaft having a proximal end and a distal end; a jaw assembly positioned at the distal end of the shaft, the jaw assembly comprising; a first jaw; and a second jaw arranged to receive a staple cartridge having a plurality of staples and movable along the longitudinal axis towards the first jaw; an actuator coupled to the proximal end of the shaft; a staple pusher coupled to the actuator and movable along the longitudinal axis to push the plurality of staples out of the cartridge along the longitudinal axis; a cartridge support having a proximal end and a distal end, the second jaw positioned on the distal end of the cartridge support, and the cartridge support extending along the shaft such that the proximal end of the cartridge support is positioned within the actuator, the proximal end of the cartridge support having first, second and third slots formed therein; a latch movable perpendicular to the longitudinal axis to be engaged sequentially with each of the first, second and third slots of the cartridge support; and a release latch connected to the latch and selectively operable to disengage the latch from the slots of the cartridge support. - View Dependent Claims (8, 9, 10, 11, 12, 13, 14)

15. A surgical stapler comprising:

a shaft extending along a longitudinal axis, the shaft having a proximal end and a distal end; an actuator positioned at the proximal end of the shaft; a cartridge support having a proximal end and a distal end, the cartridge support extending longitudinally along the shaft and movable longitudinally with respect to the shaft, the cartridge support operatively coupled to the actuator; a jaw assembly positioned at the distal end of the shaft, the jaw assembly comprising; a first jaw; a second jaw opposite the first jaw, the second jaw positioned at the distal end of the cartridge support and movable with respect to the first jaw to define an open configuration of the jaw assembly wherein the first jaw is spaced apart from the second jaw and a closed configuration of the jaw assembly wherein the first jaw is adjacent the first jaw; and a capture member positioned at least partially in the second jaw and extendable towards the first jaw between a retracted position and an extended position; a capture member driver having a proximal end and a distal end, the capture member driver operatively coupled to the capture member; and a pivot lever having a fist end pivotally coupled to the proximal end of the capture member driver and a second end opposite the first end, the second end operatively coupled to the cartridge support such that longitudinal movement of the cartridge support pivots the pivot lever to drive the capture member driver generally longitudinally. - View Dependent Claims (16, 17, 18)
