Abstract

A method and apparatus allows a customer to indicate his or her brand indifference within a product category, and then receive a benefit for purchasing a product chosen by a third party from within this product category. This method and apparatus is particularly useful in differentiating between brand-loyal or brand-sensitive customers and brand-indifferent customers, and allows manufacturers to price-discriminate between these two types of customers. The method includes a step during which an indication of at least one product or service category of interest is received from a customer or other potential purchaser, a step during which a selection of at least one product or service is made that matches the indicated product or service category, a step during which an indication of the selected product or service is provided to the customer or other potential purchaser or to a device used or accessible by the customer or other potential purchaser, a step during which an indication is received that the customer or other potential purchaser has actually purchased, rented, leased, obtained, etc. the selected product or service, and a step during which a benefit is provided to the customer or purchaser who actually purchased, rented, leased, obtained, etc. the selected product or service, or to some other person or entity designated by the customer or some other person or entity.

Claims

1. A method, comprising:

receiving an agreement from a customer to purchase a product from a product category, wherein the product category is selected by the customer such that the selection is not indicative of a customer preference among a plurality of products of the product category;

selecting, for the customer, one of the plurality of products from the product category;

determining a value of a benefit to provide;

providing, to the customer, an indication of the selected product and the benefit;

receiving an indication of a purchase of the selected product by the customer; and

providing the benefit based on the purchase.

2. The method of claim 1, wherein the agreement received from the customer to purchase the product includes a purchase price.

3. The method of claim 1, in which selecting one of the plurality of products comprises a retailer selecting the product for the customer.

4. The method of claim 3, wherein the retailer provides the indication of the selected product to the customer.

5. The method of claim 3, further comprising providing an indication to the customer of at least two retail locations of the retailer that have the selected product in inventory.

6. The method of claim 3, further comprising shipping the selected product to the customer.

7. The method of claim 3, in which providing the benefit further comprises basing at least a part of the benefit upon the determination of whether the selected product was purchased from the retailer.

8. The method of claim 1, in which selecting the product depends on at least one of inventory information, a subsidy, a promotion, an expiration date, product availability, cost, a date, a season, the customer'"'"'s purchasing history, the customer'"'"'s status, demographic information, or the occurrence of an event.

9. The method of claim 1, wherein the customer creates at least one product category by selecting at least two products and associating the at least two products with a product category.

10. The method of claim 1, in which determining the value of the benefit comprises basing the value on the product category selected by the customer.

11. The method of claim 10, further comprising determining the value based on the number of products in the product category.

12. The method of claim 1, in which determining the value of the benefit comprises basing the value on the product selected for the customer.

13. The method of claim 12, wherein the benefit is greater for a first product of the product category than for a second product of the product category.

14. The method of claim 1, further comprising:

receiving sales information associated with the purchase of the selected product by the customer; and

using the sales information to determine the value of the benefit to provide.

15. The method of claim 14, wherein the sales information is received from a retailer.

16. The method of claim 14, wherein the sales information comprises at least one of the time of purchase of the selected product, and the identity of the retailer where the customer purchased the selected product.

17. The method of claim 1, in which determining the value of the benefit comprises basing the value on at least one of the lowest cost of a product within the category, the highest cost of a product within the category, or the time the purchase occurred.

18. The method of claim 1, in which providing an indication of the selected product further comprises providing purchasing instructions to the customer.

19. The method of claim 1, wherein the indication of a purchase of the selected product is received from at least one of the customer, a customer device, a retailer, a retailer device, a seller, a seller device, or a controller.

20. The method of claim 1, in which providing the benefit comprises providing the benefit to at least one of the customer, another person different from the customer, an entity, another person designated by the customer, or an entity designated by the customer.

21. The method of claim 1, wherein at least one of a manufacturer, a retailer, or a third party provides the benefit.

22. The method of claim 1, further comprising determining a price for the selected product and providing an indication of a price for the selected product.

23. The method of claim 1, further comprising determining a condition of purchase for the selected product.

24. The method of claim 23, further comprising providing an indication of the condition of purchase of the selected product.

25. The method of claim 24, further comprising imposing a penalty if the purchase of the selected product is not completed in accordance with the condition of purchase.

26. The method of claim 1, wherein the agreement is a binding commitment to purchase a product that is selected for the customer.

27. The method of claim 1, in which the benefit is provided by crediting an account of the customer.

28. The method of claim 1, in which the benefit comprises a rebate.

29. The method of claim 28, wherein the rebate comprises an alternate currency.

30. A computer readable medium storing instructions configured to direct a processor to:

receive an agreement from a customer to purchase a product from a product category, wherein the product category is selected by the customer such that the selection is not indicative of a customer preference among a plurality of products of the product category;

select, for the customer, one of the plurality of products from the product category;

determine a value of a benefit to provide;

provide, to the customer, an indication of the selected product and the benefit;

receive an indication of a purchase of the selected product by the customer; and

provide the benefit based on the purchase.

31. The computer readable medium of claim 30, in which the instructions for receiving the agreement comprise instructions configured to direct the processor to obtain a purchase price.

32. The computer readable medium of claim 30, in which the instructions for selecting one of the plurality of products for the customer comprise instructions configured to direct the processor to receive the selection from a retailer.

33. The computer readable medium of claim 32, which further comprises instructions configured to direct the processor to provide an indication to the customer of at least two retail locations of the retailer that have the selected product in inventory.

34. The computer readable medium of claim 32, which further comprises instructions configured to direct the processor to provide customer information to the retailer to enable shipment of the product to the customer.

35. The computer readable medium of claim 32, which further comprises instructions configured to direct the processor to determine at least a part of the benefit based upon whether the selected product was purchased from the retailer.

36. The computer readable medium of claim 30, in which the instructions for selecting the product comprise instructions configured to direct the processor to determine the selection based on at least one of inventory information, a subsidy, a promotion, an expiration date, product availability, cost, a date, a season, the customer'"'"'s purchasing history, the customer'"'"'s status, demographic information, or the occurrence of an event.

37. The computer readable medium of claim 30, in which the instructions for receiving the agreement from a customer to purchase a product from a product category further comprises instructions configured to direct the processor to:

receive a customer selection and association of at least two products with a product category;

generate a product category that includes the at least two products; and

associate the product category with the customer.

38. The computer readable medium of claim 30, in which the instructions for determining the value of the benefit comprises instructions configured to direct the processor to determine the value based on the product category selected by the customer.

39. The computer readable medium of claim 38, which further comprises instructions configured to direct the processor to determine the value based on the number of products in the product category.

40. The computer readable medium of claim 30, in which the instructions for determining the value of the benefit comprises instructions configured to direct the processor to determine the value based on the product selected for the customer.

41. The computer readable medium of claim 40, which further comprises instructions configured to direct the processor to determine the value of the benefit based on at least one of a first product of the product category or a second product of the product category, wherein the value is greater for the first product than for the second product.

42. The computer readable medium of claim 30, which further comprises instructions configured to direct the processor to:

receive sales information associated with the purchase of the selected product by the customer; and

determine the value of the benefit to provide based on the sales information.

43. The computer readable medium of claim 42, in which the instructions for receiving the sales information and determining the value of the benefit comprises instructions configured to direct the processor to receive the sales information from a retailer.

44. The computer readable medium of claim 42, in which the instructions for receiving the sales information comprises instructions configured to direct the processor to obtain at least one of the time of purchase of the selected product, and the identity of the retailer where the customer purchased the selected product.

45. The computer readable medium of claim 30, in which the instructions for determining the value of the benefit comprises instructions configured to direct the processor to base the value on at least one of the lowest cost of a product within the category, the highest cost of a product within the category, or the time the purchase occurred.

46. The computer readable medium of claim 30, in which the instructions for providing an indication of the selected product further comprises instructions configured to direct the processor to provide purchasing instructions to the customer.

47. The computer readable medium of claim 30, in which the instructions for receiving the indication of the purchase of the selected product comprises instructions configured to direct the processor to receive the indication from at least one of the customer, a customer device, a retailer, a retailer device, a seller, a seller device, or a controller.

48. The computer readable medium of claim 30, in which the instructions for providing the benefit comprises instructions configured to direct the processor to provide the benefit to at least one of the customer, another person different from the customer, an entity, another person designated by the customer, or an entity designated by the customer.

49. The computer readable medium of claim 30, which further comprises instructions configured to direct the processor to:

determine a price for the selected product; and

provide an indication of the price for the selected product.

50. The computer readable medium of claim 30, which further comprises instructions configured to direct the processor to determine a condition of purchase for the selected product.

51. The computer readable medium of claim 50, which further comprises instructions configured to direct the processor to provide an indication of the condition of purchase of the selected product.

52. The computer readable medium of claim 50, which further comprises instructions configured to direct the processor to impose a penalty if the purchase of the selected product is not completed in accordance with the condition of purchase.

53. The computer readable medium of claim 30, in which the instructions for providing the benefit comprise instructions configured to direct the processor to credit an account of the customer.

54. The computer readable medium of claim 30, in which the instructions for providing the benefit comprise instructions configured to direct the processor to provide a rebate.

55. An apparatus, comprising:

a memory;

a communication port; and

a processor connected to the memory and the communication port, the processor being operative to;

receive an agreement from a customer to purchase a product from a product category, wherein the product category is selected by the customer such that the selection is not indicative of a customer preference among a plurality of products of the product category;

select, for the customer, one of the plurality of products from the product category;

determine a value of a benefit to provide;

provide, to the customer, an indication of the selected product and the benefit;

receive an indication of a purchase of the selected product by the customer; and

provide the benefit based on the purchase.

56. The apparatus of claim 55, further comprising at least one of a clock, an output device, or an input device.

57. The apparatus of claim 55, wherein the memory comprises at least one of a product and service category database, a product and service database, a customer database, a retailer database, an agreement database, or a transaction database.

58. A method, comprising:

receiving, from a customer, a selection of at least two products to form a product category, wherein the products are acceptable alternatives of each other;

receiving an agreement from the customer to purchase at least one product from the product category, wherein the agreement does not include a preference among the products of the product category;

selecting, for the customer, one of products from the product category;

providing an indication of the selected product;

receiving an indication that the customer purchased the selected product; and

providing a benefit.

59. The method of claim 58, in which receiving the selection of at least two products to form a product category further comprises receiving an indication from the customer of at least one product to exclude from the product category.

60. The method of claim 58, in which receiving the agreement comprises receiving an amount that the customer is willing to pay for the product.

61. The method of claim 58, further comprising:

selecting a retailer for the customer from a plurality of retailers offering the product for sale; and

providing an indication of the selected retailer.

62. The method of claim 58, in which selecting one of the plurality of products comprises a retailer selecting the product for the customer.

63. The method of claim 62, wherein the retailer provides the indication of the selected product to the customer.

64. The method of claim 62, further comprising providing an indication to the customer of at least two retail locations of the retailer that have the selected product in inventory.

65. The method of claim 62, further comprising shipping the selected product to the customer.

66. The method of claim 58, in which selecting the product comprises basing the selection on at least one of inventory information, a subsidy, a promotion, an expiration date, product availability, cost, a date, a season, the customer'"'"'s purchasing history, the customer'"'"'s status, demographic information, or the occurrence of an event.

67. The method of claim 58, further comprising, after selecting the product from the product category, determining the value of the benefit.

68. The method of claim 67, in which determining the value of the benefit comprises determining the value based on at least one of the product category selected by the customer, the number of products selected, or the particular product selected for, and purchased by, the customer.

69. The method of claim 67, in which determining the value of the benefit comprises determining the value based on at least one of the lowest cost of a product within the category, the highest cost of a product within the category, or the time the purchase occurred.

70. The method of claim 58, in which providing an indication of the selected product further comprises providing purchasing instructions to the customer.

71. The method of claim 58, in which providing the benefit further comprises basing at least a part of the value of the benefit upon the determination of whether the selected product was purchased from the retailer.

72. The method of claim 58, in which providing the benefit comprises providing the benefit to at least one of the customer, another person different from the customer, an entity, another person designated by the customer, or an entity designated by the customer.

73. The method of claim 58, wherein at least one of a manufacturer, a retailer, or a third party provides the benefit.

74. The method of claim 58, further comprising:

determining a condition of purchase for the selected product; and

providing an indication of the condition of purchase of the selected product.

75. The method of claim 74, further comprising imposing a penalty if the purchase of the selected product is not completed in accordance with the condition of purchase.

76. The method of claim 58, in which the benefit comprises a rebate.

77. The method of claim 76, wherein the rebate comprises an alternate currency.

78. A computer readable medium storing instructions configured to direct a processor to:

receive, from a customer, a selection of at least two products to form a product category, wherein the products are acceptable alternatives of each other;

receive an agreement from the customer to purchase at least one product from the product category, wherein the agreement does not include a preference among the products of the product category;

select, for the customer, one of products from the product category;

provide an indication of the selected product;

receive an indication that the customer purchased the selected product; and

provide a benefit.

79. The computer readable medium of claim 78, in which the instructions for receiving the selection of at least two products to form a product category comprise instructions configured to direct the processor to receive an indication from the customer of at least one product to exclude from the product category.

80. The computer readable medium of claim 78, in which the instructions for receiving the agreement comprise instructions configured to direct the processor to receive an amount that the customer is willing to pay for the product.

81. The computer readable medium of claim 78, which further comprises instructions configured to direct the processor to:

select a retailer for the customer from a plurality of retailers offering the product for sale; and

provide an indication of the selected retailer.

82. The computer readable medium of claim 78, in which the instructions for selecting one of the plurality of products for the customer comprise instructions configured to direct the processor to receive the selection of the product from a retailer.

83. The computer readable medium of claim 82, which further comprises instructions configured to direct the processor to provide an indication to the customer of at least two retail locations of the retailer that have the selected product in inventory.

84. The computer readable medium of claim 82, which further comprises instructions configured to direct the processor to provide customer information to the retailer to enable shipment of the product to the customer.

85. The computer readable medium of claim 78, in which the instructions for selecting one of the plurality of products for the customer comprise instructions configured to direct the processor to determine the selection based on at least one of inventory information, a subsidy, a promotion, an expiration date, product availability, cost, a date, a season, the customer'"'"'s purchasing history, the customer'"'"'s status, demographic information, or the occurrence of an event.

86. The computer readable medium of claim 78, which further comprises instructions configured to direct the processor to, after selection of the product from the product category, determine the value of the benefit.

The computer readable medium of claim 86, in which the instructions for determining the value of the benefit comprise instructions configured to direct the processor to determine the value based on at least one of the product category selected by the customer, the number of products selected, or the particular product selected for, and purchased by, the customer.

88. The computer readable medium of claim 86, in which the instructions for determining the value of the benefit comprise instructions configured to direct the processor to determine the value based on at least one of the lowest cost of a product within the category, the highest cost of a product within the category, or the time the purchase occurred.

89. The computer readable medium of claim 78, in which the instructions for providing an indication of the selected product comprise instructions configured to direct the processor to provide purchasing instructions to the customer.

90. The computer readable medium of claim 78, in which the instructions for providing the benefit comprise instructions configured to direct the processor to base at least a part of the value of the benefit upon the determination of whether the selected product was purchased from the retailer.

91. The computer readable medium of claim 78, in which the instructions for providing the benefit comprise instructions configured to direct the processor to provide the benefit to at least one of the customer, another person different from the customer, an entity, another person designated by the customer, or an entity designated by the customer.

92. The computer readable medium of claim 78, in which the instructions for providing the benefit comprise instructions configured to direct the processor to instruct at least one of a manufacturer, a retailer, or a third party to provide the benefit.

93. The computer readable medium of claim 78, which further comprises instructions configured to direct the processor to:

determine a condition of purchase for the selected product; and

provide an indication of the condition of purchase of the selected product.

94. The computer readable medium of claim 93, which further comprises instructions configured to direct the processor to impose a penalty if the purchase of the selected product is not completed in accordance with the condition of purchase.

95. The computer readable medium of claim 78, in which the instructions for providing the benefit comprise instructions configured to direct the processor to provide a rebate.

96. An apparatus, comprising:

a memory;

a communication port; and

a processor connected to the memory and the communication port, the processor being operative to;

receive, from a customer, a selection of at least two products to form a product category, wherein the products are acceptable alternatives of each other;

receive an agreement from the customer to purchase at least one product from the product category, wherein the agreement does not include a preference among the products of the product category;

select, for the customer, one of products from the product category;

provide an indication of the selected product;

receive an indication that the customer purchased the selected product; and

provide a benefit.

97. The apparatus of claim 96, further comprising at least one of a clock, an output device, or an input device.

98. The apparatus of claim 96, wherein the memory comprises at least one of a product and service category database, a product and service database, a customer database, a retailer database, an agreement database, or a transaction database.
