Abstract

A networked computer system permits users to analyze events associated with a target entity, using primarily externally reported data. By analyzing the target entity'"'"'s personnel, procedures and reports, embodiments of the invention can assess, present and predict outcomes and timings of submissions processed by the target entity/organization.

Claims

1. A method of indirectly analyzing and predicting behavior of a target organization with a computing system, which target organization processes input submissions from third parties using a staff of human personnel in accordance with a first rule set to generate output events, the method comprising:

causing the computing system to access a publicly accessible database of event records derived from the output events of the target organization, and which event records identify at least an event type and event date associated with processing by the target organization of the submission;

processing the event records to identify a historical event behavior of the target organization, including a timing performance parameter and a resolution parameter associated with the events;

generating a target prediction of additional events to be generated by the target organization using said timing performance parameter and said resolution parameter.

2. The method of claim 1 further including a step:

soliciting input from a community of users to identify a community prediction for said additional events.

3. The method of claim 1 further including a step:

generating an alert to one or more users in response to detecting a change in said target prediction exceeding a first threshold or otherwise meeting said user'"'"'s target criteria.

4. The method of claim 1 wherein the target organization is the United States Patent &

Trademark Office.

5. The method of claim 4 wherein the events are associated with preissuance or post grant challenge proceeding.

6. The method of claim 1, further including a step:

predicting an amount of representative fees required to process said events.

8. The method of claim 6 further including a step:

updating a profile of said human staff personnel based on input by users of the computing system who have experience with said human staff personnel so that said profile includes both objective data identified from said event records and subjective data provided by users familiar with said persons.

9. The method of claim 6 wherein a loading factor associated with a current and/or expected case load experience by the human staff personnel is accounted for in deriving said prediction.

10. The method of claim 1 wherein the human staff personnel are with the United States Patent &

Trademark Office.

11. The method of claim 9 wherein the events are associated with preissuance or post grant challenge proceeding.

13. The method of claim 11 wherein said hypothetical submission is a post grant challenge to a patent filed in the United States Patent &

Trademark Office (USPTO).

14. The method of claim 11 wherein said hypothetical submission includes at least:

1) a proposed patent;

     2) a proposed challenge filing submission;

     3) a proposed prior art reference.

15. The method of claim 13 wherein a score is derived for said proposed patent indicating a probability of a successful or an unsuccessful resolution in the USPTO based on said hypothetical submission.

16. The method of claim 13, wherein said hypothetical submission further specifies an entity to be associated with filing said submission, and said prediction is based on a prior resolution performance by said entity in the USPTO.

17. The method of claim 13, wherein said hypothetical submission further specifies a legal representative to be associated with filing said submission, and said prediction is based on a prior resolution performance by said legal representative in the USPTO.

18. The method of claim 13 wherein said output is based on a natural language comparison of said proposed prior art reference and said proposed patent.

19. The method of claim 13 wherein said output is based on comparing said proposed patent to a cluster of prior patents previously challenged in the USPTO and best matching characteristics of said proposed patent to identify a nominal expected resolution score.

20. The method of claim 11 wherein said output includes a predicted time for completing said post-grant challenge.

7. A method of indirectly analyzing and predicting behavior of a human staff personnel of a target organization with a computing system, which target organization processes input submissions from third parties using the staff of human personnel in accordance with a first rule set to generate output events, the method comprising:

causing the computing system to access a publicly accessible database of event records derived from the output events of the target organization, and which event records identify at least an event type and event date associated with processing by the human staff personnel of the submission;

processing the event records to identify a historical event behavior of the human staff personnel, including a timing performance parameter and a resolution parameter associated with the events;

generating a prediction of additional events to be generated by the human staff personnel using said timing performance parameter and said resolution parameter.

A method of indirectly analyzing and predicting behavior of a target organization with a computing system, which target organization processes input submissions from third parties using a staff of human personnel in accordance with a first rule set to generate output events, the method comprising:

causing the computing system to access a publicly accessible database of event records derived from the output events of the target organization, and which event records identify at least an event type and event date associated with processing by the target organization of the submission;

processing the event records to identify a historical event behavior of the target organization, including a timing performance parameter and a resolution parameter associated with the events;

identifying a hypothetical submission to be processed by the target organization;

generating a prediction of an output expected to be generated by the target organization for said hypothetical submission using said timing performance parameter and said resolution parameter.

21. A method of indirectly analyzing behavior of a target organization with a computing system, which target organization processes input submissions from third parties using a staff of human personnel in accordance with a first rule set to generate output events, the method comprising:

causing the computing system to access a publicly accessible database of event records derived from the output events of the target organization, and which event records identify at least an event type and event date associated with processing by the target organization of the submission;

receiving a query parameter from a user, including at least one of a keyword parameter, a submission classification parameter, an employee name, an organization number, a representative name, or an entity name;

processing the event records to identify a historical event behavior of the target organization with respect to submissions associated with said query parameter, including a number of submissions processed by the target organization, and a number of selected target events associated with said output events for said query parameter;

generating a visual map for the target organization which identifies distinct regions by a size and visual shading or color a number of submissions and selected target events matching said query parameter.

22. The method of claim 21 wherein said target organization is the United States Patent &

Trademark Office (USPTO).

23. The method of claim 21 wherein visual map only identifies an output matching a selectable threshold specified by said user.

24. The method of claim 21 wherein a ratio of submissions to target events is identified by said visual shading or color.

25. The method of claim 22, wherein a breakdown of a success rate in granting patents by an examiner, a filing entity or a representative is presented.

26. A system for indirectly analyzing and predicting behavior of a target organization, which target organization processes input submissions from third parties using a staff of human personnel in accordance with a first rule set to generate output events, the system comprising:

a computer server computing system operatively connected to a network;

a first module configured to cause said computer server computing system to access a publicly accessible database of event records derived from the output events of the target organization, and which event records identify at least an event type and event date associated with processing by the target organization of the submission;

a second module configured to process the event records to identify a historical event behavior of the target organization, including a timing performance parameter and a resolution parameter associated with the events;

a third module configured to generate a target prediction of additional events to be generated by the target organization or personnel thereof using said timing performance parameter and said resolution parameter.
