1. A safety penetrating instrument comprisingan elongate penetrating member having a proximal end and a distal end having a sharp tip for penetrating tissue;
- a safety probe including a protective body disposed adjacent said distal end of said penetrating member and having an extended position with at least a portion of said protective body protruding distally of said sharp tip and a retracted position with said body disposed to expose said sharp tip, said protective body being made of a flexible, pliable material allowing contact with tissue within the body without injury to the tissue, said protective body being resilient to permit said protective body to be moved to said retracted position in response to forces from contact of said protective body with tissue and to permit said protective body to resiliently return to said extended position upon removal of the forces from tissue contact, said protective body having a portion configured to be compressed in said retracted position and to be expanded in said extended position, said protective body portion having an accordion-like, folded configuration;
a hub receiving said proximal end of said penetrating member;
a housing abutting said hub; and
an elongate, tubular portal sleeve surrounding said penetrating member and having a distal end disposed adjacent said penetrating member distal end and a proximal end secured to said housing.

Abstract
A safety penetrating instrument for introducing a portal sleeve into an anatomical cavity particularly useful in least invasive surgery includes a safety probe having a distal end configuration cooperating with the sharp distal tip of a penetrating member to protect the tip in an extended position and to expose the tip in a retracted position. The configuration of the distal ends of the penetrating member and the safety probe in the retracted position form a solid, continuous surface tissue penetrating tip for the safety penetrating instrument. The safety probe and penetrating member can be removed from the portal sleeve as a unit or the safety probe can be removed while leaving the penetrating member in place for use in further procedures. The safety probe can carry interchangeable protective bodies on the distal end thereof, the bodies being made of flexible, pliable and preferably resilient materials.

1. A safety penetrating instrument comprising
an elongate penetrating member having a proximal end and a distal end having a sharp tip for penetrating tissue; -

2. A safety penetrating instrument comprising
an elongate penetrating member having a proximal end and a distal end having a sharp tip for penetrating tissue said penetrating member being tubular and having a longitudinal axis and said distal end of said penetrating member being open and having a leading edge defining said sharp tip, said open distal end of said penetrating member having a peripheral edge disposed in a plane positioned at an acute angle relative to said longitudinal axis of said penetrating member; - said penetrating member distal end having a portion curving toward said longitudinal axis of said penetrating member to terminate at said sharp tip;
a safety probe including a protective body disposed within said open distal end of said penetrating member and having an extended position with at least a portion of said protective body protruding distally of said sharp tip and a retracted position with said body disposed to expose said sharp tip, said protective body being made of a flexible, pliable material allowing contact with tissue within the body without injury to the tissue, said protective body having an end surface aligned with said peripheral edge of said penetrating member open distal end when said protective body is in said retracted position such that said protective body and said penetrating member distal end present a substantially continuous surface during tissue penetration; a hub receiving said proximal end of said penetrating member; a housing abutting said hub; and an elongate, tubular portal sleeve surrounding said penetrating member and having a distal end disposed adjacent said penetrating member distal end and a proximal end secured to said housing. - View Dependent Claims (3)

an elongate penetrating member having a proximal end and a distal end having a sharp tip for penetrating tissue, said penetrating member being tubular and said distal end of said penetrating member being open and having a leading edge defining said sharp tip; -
a safety probe including a protective body disposed adjacent said distal end of said penetrating member and having an extended position with at least a portion of said protective body protruding distally of said sharp tip and a retracted position with said body disposed to expose said sharp tip, said protective body being made of a flexible, pliable material allowing contact with tissue within the body without injury to the tissue; a hub for receiving said proximal end of said penetrating member; a housing abutting said hub; and an elongate, tubular portal sleeve surrounding said penetrating member and having a distal end disposed adjacent said penetrating member distal end and a proximal end secured to said housing, said safety probe including an elongate member having a distal end carrying said protective body and a proximal end received in said hub and further comprising spring means engaging said proximal end of said elongate probe member in said hub for biasing said protective body toward said extended position. - View Dependent Claims (5)

an elongate, tubular penetrating member having a proximal end and an open distal end having a leading edge defining a sharp tip for penetrating tissue; -
a safety probe including a protective body disposed within said open distal end of said penetrating member and having an extended position with at least a portion of said protective body protruding distally of said sharp tip and a retracted position with said body disposed to expose said sharp tip, said protective body being made of a flexible, pliable material allowing contact with tissue within the body without injury to the tissue; a hub receiving said proximal end of said penetrating member, said safety probe including an elongate member having a proximal end received in said hub and a distal end and coupling means for releasably mounting said protective body on said distal end of said elongate probe member whereby various protective bodies can be interchangeably carried by said safety probe; a housing abutting said hub; and an elongate, tubular portal sleeve surrounding said penetrating member and having a distal end disposed adjacent said penetrating member distal end and a proximal end secured to said housing. - View Dependent Claims (7, 8)

11. A safety penetrating instrument comprising
an elongate, hollow penetrating member having a proximal end and an open distal end defining a sharp tip for penetrating tissue; -
safety probe means movably disposed in said penetrating member including a protective body movable between an extended position protruding distally from said sharp tip and a retracted position disposed within said penetrating member to expose said sharp tip; bias means disposed adjacent said distal end of said penetrating member for biasing said protective body toward said extended position and for permitting said protective body to move proximally to said retracted position in response to a proximally directed force applied to said protective body, said bias means returning said protective body to said extended position when the force applied to said protective body is removed; a hub receiving said proximal end of said penetrating member; a housing means abutting said hub; and an elongate, tubular portal sleeve surrounding said penetrating member and having a proximal end secured to said housing and a distal end disposed adjacent said penetrating member distal end. - View Dependent Claims (12, 13, 14)
