Abstract

An isolated DNA sequence capable of serving as regulatory element in a chimeric gene which can be used for the transformation of plants is disclosed. A chimeric gene for the transformation of plants is also disclosed. The gene comprises at least, in the direction of transcription, a promoter sequence, a transgene and a regulatory element, characterized in that the regulatory element consists of at least one intron 1 in the noncoding 5′ region of a plant histone gene allowing the expression of the protein in the zones and undergoing rapid growth. The production of transgenic plants is also disclosed.

Claims

1. An isolated intron 1 from a plant H3.3-like histone gene selected from the group consisting of SEQ ID NO:

6 and SEQ ID NO;

7, wherein said intron 1 serves as a genetic regulatory element in a chimeric gene which can be used for the transformation of plants and allow the expression of the product of translation of the chimeric gene in the regions of the plant undergoing rapid growth.

2. The intron 1 according to claim 1, wherein said H3.3-like histone gene is from a dicotyledonous plant.

3. A chimeric gene for the transformation of plants comprising, in the direction of transcription, a promoter sequence, the intron 1 according to claims 1, 2, a full length sequence of a herbicide tolerance gene and a DNA polyadenylation site.

4. The chimeric gene according to claim 3, wherein said promoter sequence is from a promoter of a plant histone gene.

5. The chimeric gene according to claim 3, wherein said promoter sequence is from the same plant histone gene as said intron 1.

6. The chimeric gene according to claim 3, wherein said promoter sequence comprises a duplicated plant histone promoter.

7. The chimeric gene according to claim 3, wherein said promoter sequence contains at least one promoter of a plant histone gene combined with a different promoter from a gene which can be naturally expressed in plants.

8. The chimeric gene according to claim 3, wherein said herbicide tolerance gene confers on plants an enhanced tolerance to a herbicide.

9. The chimeric gene according to claim 8, wherein said herbicide tolerance gene is fused with a DNA sequence encoding a signal peptide allowing the accumulation of the product of translation of the herbicide tolerance gene in a subcellular component.

10. The chimeric gene according to claim 9, wherein said signal peptide allows the accumulation of the product of translation of the herbicide tolerance gene in the plastid compartment.

11. The chimeric gene according to claim 3, wherein said herbicide tolerance gene encodes an enzyme which is active towards herbicides whose target is EPSPS.

12. The chimeric gene according to claim 11, wherein said herbicide tolerance gene encodes an enzyme which is active towards glyphosate.

13. A vector for the transformation of plants comprising the chimeric gene according to claim 3.

14. A transformed plant cell comprising the chimeric gene according to claim 3.

15. A transformed plant, or plant part obtained from the cell according to claim 14.

16. A process for the construction of a chimeric gene comprising operably linking in the direction of transcription a promoter sequence, the intron 1 of claim 1, 2, a sequence encoding a signal peptide, at least one transgene, and a DNA polyadenylation site.

17. The Intron 1 according to claim 2, wherein said H3.3-like histone gene is from Arabidopsis thaliana.

18. A strain of Agrobacterium sp., comprising the vector according to claim 13.

19. A vector for the transformation of plants comprising the chimeric gene according to claim 4.

20. A vector for the transformation of plants comprising the chimeric gene according to claim 5.

21. A vector for the transformation of plants comprising the chimeric gene according to claim 6.

22. A vector for the transformation of plants comprising the chimeric gene according to claim 7.

23. A vector for the transformation of plants comprising the chimeric gene according to claim 8.

24. A vector for the transformation of plants comprising the chimeric gene according to claim 10.

25. A vector for the transformation of plants comprising the chimeric gene according to claim 11.

36. A process for the construction of a chimeric gene comprising operably linking in the direction of transcription a promoter sequence, the intron 1 of claim 17, a sequence encoding signal peptide, at least one transgene, and a DNA polyadenylation site.
