Computerized method and system of estimating liability and range of liability for an accident
First Claim
1. A method of estimating liability and a range of liability for a vehicle accident, comprising:
- estimating a base liability of a party in a vehicle accident, a lower bound of liability of the party, and an upper bound of liability of the party with a computer system, wherein the base liability is a portion of the liability of the party for the accident that is independent of factors specific to condition of vehicles in the accident, condition of drivers in the accident, actions of drivers in the accident, and environmental conditions common to vehicles in the accident, wherein the lower bound is greater than zero percent or the upper bound is less than 100 percent;
estimating an effect of one or more factors on the liability of the party with a computer system;
wherein the one or more factors depend upon conditions of vehicles in the vehicle accident, conditions of drivers in the vehicle accident, actions of drivers in the vehicle accident, or environmental conditions common to vehicles in the vehicle accident; and
combining the estimate of the base liability with the estimate of the effect of the one or more factors on the liability.

Abstract
Methods and systems are provided for estimating liability in an accident. In an embodiment, a liability estimate may include an upper bound of liability and a lower bound of liability. In one embodiment, liability estimation in a vehicle accident may be based on a plurality of characteristics that describe the accident. These characteristics may include: the configuration of the roadway, the type of accident, right of way, and impact points of each vehicle. The characteristics from an actual accident may be compared to those in a past or theoretical accident. Liability may be estimated from a preassigned liability associated with a nearest matching past or theoretical accident. The liability estimate may include a base liability and one or more adjustments due to various factors.

-
estimating a base liability of a party in a vehicle accident, a lower bound of liability of the party, and an upper bound of liability of the party with a computer system; estimating an effect of one or more factors on the base liability of the party with a computer system; and wherein the one or more factors depend upon conditions of vehicles in the vehicle accident, conditions of drivers in the vehicle accident, actions of drivers in the vehicle accident, or environmental conditions common to vehicles in the vehicle accident.
