1. A method of transmitting a data packet within a telecommunication system that transmits or receives telecommunication data, wherein the system includes a header compression layer at a transmitting side capable of transmitting a full header packet having all header information and compressed header packets having compressed header information, with respect to a packet stream, the method comprising:
- transmitting at least one full header data packet to a receiver side from the transmitter side;
receiving, at a lower layer associated with the transmitter side, an acknowledgement from the receiver side that a data packet containing a full header has been successfully received;
determining, at an upper layer associated with the transmitter side, whether to send a data packet containing a compressed header to the receiver side, based on transferring an indication of the acknowledgement received from the lower layer of the transmitter side at the upper layer of the transmitter side; and
in response to said determining based on said indication of acknowledgement, transmitting a data packet containing a compressed header to the receiver side from the transmitter side,wherein the indication of a successful transmission comprises an identifier used to indicate at least one packet that was successfully received by a lower layer of a receiving side.

Abstract
A method and apparatus for a transmitter having a radio protocol with an upper layer and a lower layer therein used for management of full header packet transmission when transmitting data packets to a receiver are provided. If the upper layer receives from the lower layer, information of a successful transmission of a full header packet, the upper layer decides to stop sending any additional full header packet that contains the same full header as the previously successfully transmitted full header packet.
