System and method for establishing a call being received by a trunk on a packet network

1. A method for establishing a call over a packet network said method comprising:
- receiving, at a call control manager located on the packet network, a call request via an originating trunk on a packet network from an originating call device of a calling determining, by the call control manager, a transmission path from the originating trunk to a terminating segment of a terminating call device;
determining status of the originating trunk, wherein determining status of the originating trunk includes determining a worst operational performance of status parameters used for determining status;
determining status of the terminating segment;
responsive to a determination that the status of the originating trunk and terminating segment are within a;
first range, establishing the call between the originating and terminating call device over the determined transmission path at a first data rate;
responsive to a determination that the status of the originating trunk or terminating segment is within a second range, determining whether the originating trunk and terminating segment can operate at a second, lower data rate;
responsive to a determination that the originating trunk and terminating segment can operate at a second, lower data rate, establishing the call over the transmission path between the originating call device and terminating call device at the second, lower data rate, wherein establishing the call over the transmission path between the originating call device and terminating call device at the second, lower data rate comprises;
sending, by the call control manager, an invite with the second, lower data rate to the terminating segment;
receiving, at the call control manager, a positive response message from the terminating segment in response to the invite containing the second, lower data rate; and
sending, by the call control manager, an information message to the originating trunk that includes the second, lower data rate;
responsive to a determination that the originating trunk and terminating segment cannot operate at a second, lower data rate, sending a call reject message to the originating line, automatically continue to regularly attempt to set-up the call;
responsive to a determination that the call request is able to be established, notifying the calling party that the call can now be set-up; and
rejecting the call request if status of either the originating trunk or terminating segment is within a third range, and sending a reject message to the originating call device.

Abstract
A method for establishing a call over a packet network may include receiving a call request via an originating trunk on a packet network from an originating call device. Status of an originating trunk and terminating segment may be determined. If the status of the originating trunk and terminating segment are within a first range, the call between the originating and terminating call device over the determined transmission path at a first data rate may be established. Otherwise, if the status of the originating trunk or terminating segment is within a second range, a determination as to whether the originating trunk and terminating segment can operate at a second, lower data rate may be made, and, if so, the call may be established over the transmission path between the originating call device and terminating call device at the second, lower data rate.

9. A system for establishing a call over a packet network said system comprising:

an input/output (I/O) unit configured to communicate over a network; a storage unit configured to store network performance information associated with node segments on the packet network; a processing unit in communication with said I/O unit and said storage unit and configured to; receive a call request via an originating trunk on a packet network from an originating call device; determine a transmission path from the originating trunk to a terminating segment of a terminating call device; determine status of the originating trunk, wherein said processing unit, in determining status of the originating trunk, is further configured to determine a worst operational performance of status parameters used for determining status; determine status of the terminating segment; responsive to a determination that the status of the originating trunk and terminating segment are within a first range, establish the call between the originating and terminating call device over the determined transmission path at a first data rate; responsive to a determination that the status of the originating trunk or terminating segment is within a second range, determine whether the originating trunk and terminating segment can operate at a second, lower data rate; responsive to a determination that the originating trunk and terminating segment can operate at a second, lower data rate, establish the call over the transmission path between the originating call device and terminating call device at the second, lower data rate, wherein establishing the call over the transmission path between the originating call device and terminating call device at the second, lower data rate comprises; send an invite with the second, lower data rate to the terminating segment; receive a positive response message from the terminating segment in response to the invite containing the second, lower data rate; and send an information message to the originating trunk that includes the second, lower data rate; responsive to a determination that the originating trunk and terminating segment cannot operate at a second, lower data rate, send a call reject message to the originating line and automatically continue to attempt to set-up the call; responsive to a determination that the call request is able to be established, notify the calling party that the call can now be set-up; and wherein said processing unit is further configured to reject the call request if status of either the originating trunk or terminating segment is within a third range. - View Dependent Claims (10, 11, 12, 13, 14, 15, 16)
